6     Section 20.  Subsection (1), (2), (4), (5), (6), (11), and
7(13) of section 1007.271, Florida Statutes, are amended to read:
8     1007.271  Dual enrollment programs.--
9     (1)  The dual enrollment program is the enrollment of an
10eligible secondary student or home education student in a
11postsecondary course creditable toward high school completion
12and a career certificate or an associate or baccalaureate
13degree.
14     (2)  For the purpose of this section, an eligible secondary
15student is a student who is enrolled in a Florida public
16secondary school or in a Florida private secondary school which
17is in compliance with s. 1002.42(2) and conducts a secondary
18curriculum pursuant to s. 1003.43. Students enrolled in
19postsecondary instruction that is not creditable toward the high
20school diploma shall not be classified as dual enrollments.
21Students who are eligible for dual enrollment pursuant to this
22section shall be permitted to enroll in dual enrollment courses
23conducted during school hours, after school hours, and during
24the summer term. Instructional time for such enrollment may
25exceed 900 hours; however, the school district may only report
26the student for a maximum of 1.0 FTE, as provided in s.
271011.61(4). Dual enrollment instruction of high school students
28that is eligible for high school and postsecondary credit shall
29be reported by the school district in an amount equal to the
30hours of instruction that would be necessary to earn the FTE
31for the equivalent course if it were taught in the school
32district. Any student so enrolled is exempt from the payment of
33registration, tuition, and laboratory fees. Vocational-
34preparatory instruction, college-preparatory instruction and
35other forms of precollegiate instruction, as well as physical
36education courses that focus on the physical execution of a
37skill rather than the intellectual attributes of the activity,
38are ineligible for inclusion in the dual enrollment program.
39Recreation and leisure studies courses shall be evaluated
40individually in the same manner as physical education courses
41for potential inclusion in the program.
42     (4)  Career dual enrollment shall be provided as a
43curricular option for secondary students to pursue in order to
44earn a series of elective credits toward the high school
45diploma. However, career dual enrollment shall not supplant
46student acquisition of the diploma. Career dual enrollment shall
47be available for secondary students seeking a degree or
48certificate from a complete career-preparatory program and shall
49not be used to enroll students, but shall not sustain student
50enrollment in isolated career courses. It is the intent of the
51Legislature that career dual enrollment provide reflect the
52interests and aptitudes of the student. The provision of a
53comprehensive academic and career dual enrollment program within
54the career center or community college is supportive of
55legislative intent; however, such provision is not mandatory.
56     (5)  Each district school board shall inform all secondary
57students of dual enrollment as an educational option and
58mechanism for acceleration. Students shall be informed of
59eligibility criteria, the option for taking dual enrollment
60courses beyond the regular school year, and the 24 minimum
61academic credits required for graduation. District school boards
62shall annually assess the demand for dual enrollment and other
63advanced courses, and the district school board shall consider
64strategies and programs to meet that demand.
65     (6)  The Commissioner of Education shall appoint faculty
66committees representing public school, community college, and
67university faculties to identify postsecondary courses that meet
68the high school graduation requirements of s. 1003.43, and to
69establish the number of postsecondary semester credit hours of
70instruction and equivalent high school credits earned through
71dual enrollment pursuant to this section that are necessary to
72meet high school graduation requirements. Such equivalencies
73shall be determined solely on comparable course content and not
74on seat time traditionally allocated to such courses in high
75school. The Commissioner of Education shall recommend to the
76State Board of Education those postsecondary courses identified
77to meet high school graduation requirements, based on mastery of
78course outcomes, by their statewide course numbers number, and
79all high schools shall accept these postsecondary education
80courses toward meeting the requirements of s. 1003.43.
81     (11)  The Department of Education shall approve any course
82for inclusion in the dual enrollment program that is contained
83within the statewide course numbering system. However, college-
84preparatory and other forms of precollegiate instruction, and
85physical education and other courses that focus on the physical
86execution of a skill rather than the intellectual attributes of
87the activity, may not be so approved, but must be evaluated
88individually for potential inclusion in the dual enrollment
89program. This subsection does not mean that an independent
90postsecondary institution eligible for inclusion in a dual
91enrollment or early admission program pursuant to s. 1011.62
92must participate in the statewide course numbering system
93developed pursuant to s. 1007.24 to participate in a dual
94enrollment program.
95     (13)  It is the intent of the Legislature that Students who
96meet the eligibility requirements of this section subsection and
97who choose to participate in dual enrollment programs are be
98exempt from the payment of registration, tuition, and laboratory
99fees.
