11  The Committee on Community Affairs (Bennett) recommended the
12  following amendment:

14         Senate Amendment 
15         On page 22, lines 15-23, delete those lines
16  
17  and insert:  
18         (c)  160 days have passed since reaching substantial
19  completion of the construction services purchased, as defined
20  in the contract, or if not defined in the contract, since
21  reaching beneficial occupancy or use of the project.
22         (d)  The claimant has asked the contractor, in writing,
23  for any of the following information and the contractor has
24  failed to respond to the claimant's request, in writing,
25  within 10 days after receipt of the request:
26         1.  Whether the project has reached substantial
27  completion, as that term is defined in the contract, or if not
28  defined in the contract, if beneficial occupancy or use of the
29  project has occurred.
30         2.  Whether the contractor has received payment of the
31  claimant's retainage, and if so, the date the retainage was
