1 A bill to be entitled
2 An act relating to alarm system contracting;
3 amending s. 633.702, F.S.; providing a criminal
4 penalty for intentionally or willfully
5 installing, servicing, testing, repairing,
6 improving, or inspecting a fire alarm system
7 unless the person who performs those acts has
8 certain qualifications or is exempt under s.
9 489.503, F.S.; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (4) is added to section 633.702,
14 Florida Statutes, to read:
15 633.702 Prohibited acts regarding alarm system
16 contractors or certified unlimited electrical contractors;
17 penalties.--
18 (4) It is a misdemeanor of the first degree,
19 punishable as provided in s. 775.082 or s. 775.083, for any
20 person to intentionally or willfully install, service, test,
21 repair, improve, or inspect a fire alarm system unless;
22 (a) The person is the holder of a valid and current
23 active license as a certified unlimited electrical contractor,
24 as defined in part II of chapter 489;
25 (b) The person is the holder of a valid and current
26 active license as a licensed fire alarm contractor, as defined
27 in part II of chapter 489;
28 (c) The person is authorized to act as a fire alarm
29 system agent pursuant to s. 489.5185; or
30 (d) The person is exempt pursuant to s. 489.503.
31 Section 2. This act shall take effect October 1, 2005.

4 The CS engrosses the amendment adopted by the Banking and
Insurance Committee to:

- Amend ch. 633, F.S., the law relating to the DSFM, to
6 provide that it is a first degree misdemeanor for any
person to intentionally or willfully install, service,
7 test, repair, improve, or inspect a fire alarm system
unless a person is a holder of a valid and current active
8 license as a certified unlimited electrical contractor; a
holder of a valid and current active license as a
9 licensed fire alarm contractor; an authorized fire alarm
system agent; or a person who is exempt under the
10 contract licensing provisions of s. 489.503, F.S.
