  1                      A bill to be entitled

  2         An act relating to alarm system contracting;

  3         amending s. 633.702, F.S.; providing a criminal

  4         penalty for intentionally or willfully

  5         installing, servicing, testing, repairing,

  6         improving, or inspecting a fire alarm system

  7         unless the person who performs those acts has

  8         certain qualifications or is exempt under s.

  9         489.503, F.S.; amending s. 489.537, F.S.;

10         revising provisions authorizing a municipality

11         or county to require that an electrical

12         journeyman be present on certain nonresidential

13         construction sites; providing for the

14         reinstatement of certain licenses that have

15         expired; providing effective dates.

17  Be It Enacted by the Legislature of the State of Florida:

18  

19         Section 1.  Subsection (4) is added to section 633.702,

20  Florida Statutes, to read:

21         633.702  Prohibited acts regarding alarm system

22  contractors or certified unlimited electrical contractors;

23  penalties.--

24         (4)  It is a misdemeanor of the first degree,

25  punishable as provided in s. 775.082 or s. 775.083, for any

26  person to intentionally or willfully install, service, test,

27  repair, improve, or inspect a fire alarm system unless;

28         (a)  The person is the holder of a valid and current

29  active license as a certified unlimited electrical contractor,

30  as defined in part II of chapter 489;

 1         (b)  The person is the holder of a valid and current

 2  active license as a licensed fire alarm contractor, as defined

 3  in part II of chapter 489;

 4         (c)  The person is authorized to act as a fire alarm

 5  system agent pursuant to s. 489.5185; or

 6         (d)  The person is exempt pursuant to s. 489.503.

 7         Section 2.  Effective July 1, 2007, paragraph (f) of

 8  subsection (3) of section 489.537, Florida Statutes, is

 9  amended to read:

10         489.537  Application of this part.--

11         (3)  Nothing in this act limits the power of a

12  municipality or county:

13         (f)  To require that one electrical journeyman, who has

14  obtained a certificate of competency from a registered

15  apprenticeship program is a graduate of the Institute of

16  Applied Technology in Construction Excellence or who is

17  licensed pursuant to s. 489.5335 prior to 2002, be present on

18  any nonresidential an industrial or commercial new

19  construction site with a facility of 15,000 50,000 gross

20  square feet or more when electrical work in excess of 98 77

21  volts is being performed in order to supervise or perform such

22  work, except as provided in s. 489.503. This paragraph does

23  not apply to single-family residential construction or any

24  commercial residential construction that is three stories or

25  less. Any person who is licensed as a journeyman electrician

26  in this state prior to 2002 and whose license has expired

27  shall have his or her journeyman certificate reinstated

28  without retesting. The local building official shall issue a

29  30-day temporary waiver for this requirement for the purposes

30  of issuing a permit if proof is provided that no journeyman is

31  available for employment on the construction site.

 1         Section 3.  Except as otherwise expressly provided in

 2  this act, this act shall take effect October 1, 2005.

 4          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 5                      CS for Senate Bill 634

 6                                 

 7  The CS for CS requires that an electrical journeyman obtain a
    certificate of competency from a registered apprenticeship
 8  program that is licensed pursuant to s. 489.5335, F.S., prior
    to 2002, be present on any nonresidential construction site of
 9  15,000 square feet or more when electrical work in excess of
    98 volts is being performed.

    It provides that the paragraph does not apply to single-family
11  residential construction or any commercial residential
    construction that is three stories or less. It provides that
12  any person who is licensed as a journeyman electrician in this
    state prior to 2002 and whose license has expired shall have
13  his or her journeyman certificate reinstated without
    retesting.  The local building official shall issue a 30 day
14  temporary waiver for this requirement for the purposes of
    issuing a permit if proof is provided that no journeyman is
15  available for employment on the construction site.
