A bill to be entitled
2An act relating to the Department of Citrus; amending s.
3601.04, F.S., relating to the membership of the Florida
4Citrus Commission; conforming provisions to changes made
5by the act; amending s. 601.09, F.S.; revising and
6reorganizing the citrus districts of the state;
7establishing four such districts; specifying the counties
8within each district; amending s. 601.154, F.S.;
9conforming provisions to changes made by the act;
10providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Paragraph (c) of subsection (1) and subsection
15(4) of section 601.04, Florida Statutes, are amended to read:
16     601.04  Florida Citrus Commission; creation and
17membership.--
18     (1)
19     (c)  There shall be three four members of the commission
20from each of the four three citrus districts. Each member must
21reside in the district from which she or he was appointed. For
22the purposes of this section, the residence of a member shall be
23the actual physical and permanent residence of the member.
24     (4)  It is the intent of the Legislature that the
25commission be redistricted every 5 years. Redistricting shall be
26based on the total boxes produced from each of the four three
27districts during that 5-year period.
28     Section 2.  Section 601.09, Florida Statutes, is amended to
29read:

32     601.09  Citrus districts.--For purposes of this chapter,
33the state is divided into four districts composed of the
34following counties:
35     (1)  Citrus District One: Levy, Alachua, Putnam, St. Johns,
36Flagler, Marion, Citrus, Sumter, Lake, Seminole, Orange,
37Hernando, Pasco, Pinellas, Hillsborough, Polk, and Osceola
38Counties.
39     (2)  Citrus District Two: Manatee, Hardee, DeSoto,
40Sarasota, Charlotte, Lee, Collier, and Monroe Counties.
41     (3)  Citrus District Three: Volusia, Brevard, Indian River,
42St. Lucie, Martin, Palm Beach, Broward, and Miami-Dade Counties.
43     (4)  Citrus District Four: Highlands, Okeechobee, Glades,
44and Hendry Counties.
45     Section 3.  Paragraph (a) of subsection (4) of section
46601.154, Florida Statutes, is amended to read:
47     601.154  Citrus Stabilization Act of Florida.--
48     (4)(a)  Every marketing order issued pursuant to the
49provisions of this section shall provide for an advisory council
50to advise the Department of Citrus in the administration
51thereof. Two members of such advisory council shall be appointed
52by the commission chair, subject to commission concurrence, from
53each of the four three citrus districts as defined in s. 601.09
54from producer nominees submitted by producers on or before the
55date of the hearing provided for in subsection (2). To qualify
56for appointment, such producer nominees shall meet the same
57qualifications as those for grower members of the commission set
58forth in s. 601.04(1).
59     Section 4.  This act shall take effect July 1, 2005.
