  1                      A bill to be entitled

  2         An act relating to traffic regulations;

  3         amending s. 316.1303, F.S.; requiring vehicle

  4         operators to stop and yield to

  5         mobility-impaired pedestrians who are assisted

  6         by guide dogs or other service animals;

  7         providing a penalty; providing an effective

  8         date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Section 316.1303, Florida Statutes, is

13  amended to read:

14         316.1303  Traffic regulations to assist

15  mobility-impaired persons.--Whenever a pedestrian is in the

16  process of crossing a public street or highway and the

17  pedestrian is mobility-impaired (using a guide dog or service

18  animal, a walker, a crutch, an orthopedic cane, or a

19  wheelchair), the driver of every vehicle approaching the

20  intersection, as defined in s. 316.003(17), shall bring his or

21  her vehicle to a full stop before arriving at such

22  intersection and, before proceeding, shall take such

23  precautions as may be necessary to avoid injuring such

24  pedestrian.  A person who is convicted of a violation of this

25  section shall be punished as provided in s. 318.18(3).

26         Section 2.  This act shall take effect July 1, 2005.

30    Requires a vehicle operator to stop and yield to a
