A bill to be entitled
2An act relating to the Criminal Justice Standards and
3Training Commission; amending s. 943.11, F.S.; requiring
4that the members of the commission who are law enforcement
5officers and who are appointed by the Governor be chosen
6from a list of nominees submitted by a collective
7bargaining agent certified by the Public Employees
8Relations Commission; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Paragraphs (a) and (b) of subsection (1) of
13section 943.11, Florida Statutes, are amended to read:
14     943.11  Criminal Justice Standards and Training Commission;
15membership; meetings; compensation.--
16     (1)(a)  There is created a Criminal Justice Standards and
17Training Commission within the Department of Law Enforcement.
18The commission shall be composed of 19 members, consisting of
19the Secretary of the Department of Corrections or a designated
20assistant; the Attorney General or a designee; the Director of
21the Division of the Florida Highway Patrol; and 16 members
22appointed by the Governor, consisting of 3 sheriffs; 3 chiefs of
23police; 5 law enforcement officers who are of the rank of
24sergeant or below within the employing agency; 2 correctional
25officers, 1 of whom is an administrator of a state correctional
26institution and 1 of whom is of the rank of sergeant or below
27within the employing agency; 1 training center director; 1
28person who is in charge of a county correctional institution;
29and 1 resident of the state who falls into none of the foregoing
30classifications. Prior to the appointment, the sheriff, chief of
31police, law enforcement officer, and correctional officer
32members must shall have had at least 4 years' experience as law
33enforcement officers or correctional officers.
34     (b)  The Governor, in making appointments under this
35section, shall take into consideration representation by
36geography, population, and other relevant factors in order that
37the representation on the commission be apportioned to give
38representation to the state at large rather than to a particular
39area. In appointing the 5 law enforcement officers, the Governor
40shall choose each appointment from a list of 6 nominees. The
41list shall be submitted by the law enforcement organization,
42inclusive of charters and chapters, which the Public Employees
43Relations Commission certifies as the collective bargaining
44agent for the largest number of certified law enforcement
45bargaining units on the date the list is submitted. The law
46enforcement organization shall submit its list of 6 nominees at
47least 3 months before the expiration of the term of any law
48enforcement officer member. Of the appointed members, and except
49for correctional officers of a state institution, there may be
50only one appointment from any employing agency.
51     Section 2.  This act shall take effect upon becoming a law.
