6An act relating to the Criminal Justice Standards and
7Training Commission; amending s. 943.11, F.S.; requiring
8that the members of the commission who are sheriffs
9appointed by the Governor be chosen from a list of
10nominees submitted by the Florida Sheriffs Association;
11requiring that the members of the commission who are
12chiefs of police appointed by the Governor be chosen from
13a list of nominees submitted by the Florida Police Chiefs
14Association; requiring that the members of the commission
15who are law enforcement officers of the rank of sergeant
16or below and the member who is a correctional officer of
17the rank of sergeant or below who are appointed by the
18Governor be chosen from a list of nominees submitted by a
19committee composed of certain collective bargaining
20agents; providing selection criteria for the committee;
21requiring lists of nominees to be submitted by a time
22certain; providing an effective date.

24Be It Enacted by the Legislature of the State of Florida:
25
26     Section 1.  Paragraphs (a) and (b) of subsection (1) of
27section 943.11, Florida Statutes, are amended to read:
28     943.11  Criminal Justice Standards and Training Commission;
29membership; meetings; compensation.--
30     (1)(a)  There is created a Criminal Justice Standards and
31Training Commission within the Department of Law Enforcement.
32The commission shall be composed of 19 members, consisting of
33the Secretary of the Department of Corrections or a designated
34assistant; the Attorney General or a designee; the Director of
35the Division of the Florida Highway Patrol; and 16 members
36appointed by the Governor, consisting of 3 sheriffs; 3 chiefs of
37police; 5 law enforcement officers who are of the rank of
38sergeant or below within the employing agency; 2 correctional
39officers, 1 of whom is an administrator of a state correctional
40institution and 1 of whom is of the rank of sergeant or below
41within the employing agency; 1 training center director; 1
42person who is in charge of a county correctional institution;
43and 1 resident of the state who falls into none of the foregoing
44classifications. Prior to the appointment, the sheriff, chief of
45police, law enforcement officer, and correctional officer
46members must shall have had at least 4 years' experience as law
47enforcement officers or correctional officers.
48     (b)  The Governor, in making appointments under this
49section, shall take into consideration representation by
50geography, population, and other relevant factors in order that
51the representation on the commission be apportioned to give
52representation to the state at large rather than to a particular
53area. Of the appointed members, and except for correctional
54officers of a state institution, there may be only one
55appointment from any employing agency.
56     1.  In appointing the 3 sheriffs, the Governor shall choose
57each appointment from a list of 6 nominees submitted by the
58Florida Sheriffs Association. The Florida Sheriffs Association
59shall submit its list of 6 nominees at least 3 months before the
60expiration of the term of any sheriff member.
61     2.  In appointing the 3 chiefs of police, the Governor
62shall choose each appointment from a list of 6 nominees
63submitted by the Florida Police Chiefs Association. The Florida
64Police Chiefs Association shall submit its list of 6 nominees at
65least 3 months before the expiration of the term of any police
66chief member.
67     3.  In appointing the 5 law enforcement officers and 1
68correctional officer of the rank of sergeant or below, the
69Governor shall choose each appointment from a list of 6 nominees
70submitted by a committee comprised of 3 members of the
71collective bargaining agent for the largest number of certified
72law enforcement bargaining units, 2 members of the collective
73bargaining agent for the second largest number of certified law
74enforcement bargaining units, and 1 member of the collective
75bargaining agent of the third largest number of certified law
76enforcement bargaining units. At least one of the names
77submitted for each of the five appointments who are law
78enforcement officers must be an officer who is not in a
79collective bargaining unit represented on the committee. The
80committee shall submit its list of 6 nominees at least 3 months
81before the expiration of the term of any law enforcement or
82correctional officer member of the rank of sergeant or below.
83     Section 2.  This act shall take effect upon becoming a law.
