11 | requiring that the members of the commission who are |
12 | chiefs of police appointed by the Governor be chosen from |
13 | a list of nominees submitted by the Florida Police Chiefs |
14 | Association; requiring that the members of the commission |
15 | who are law enforcement officers of the rank of sergeant |
16 | or below and the member who is a correctional officer of |
17 | the rank of sergeant or below who are appointed by the |
18 | Governor be chosen from a list of nominees submitted by a |
19 | committee composed of certain collective bargaining |
20 | agents; providing selection criteria for the committee; |
21 | requiring lists of nominees to be submitted by a time |
22 | certain; providing an effective date. |

24 | Be It Enacted by the Legislature of the State of Florida: |
25 |

26 | Section 1. Paragraphs (a) and (b) of subsection (1) of |
27 | section 943.11, Florida Statutes, are amended to read: |
28 | 943.11 Criminal Justice Standards and Training Commission; |
29 | membership; meetings; compensation.-- |
30 | (1)(a) There is created a Criminal Justice Standards and |
31 | Training Commission within the Department of Law Enforcement. |
32 | The commission shall be composed of 19 members, consisting of |
33 | the Secretary of the Department of Corrections or a designated |
34 | assistant; the Attorney General or a designee; the Director of |
35 | the Division of the Florida Highway Patrol; and 16 members |
36 | appointed by the Governor, consisting of 3 sheriffs; 3 chiefs of |
37 | police; 5 law enforcement officers who are of the rank of |
38 | sergeant or below within the employing agency; 2 correctional |
39 | officers, 1 of whom is an administrator of a state correctional |
40 | institution and 1 of whom is of the rank of sergeant or below |
41 | within the employing agency; 1 training center director; 1 |
42 | person who is in charge of a county correctional institution; |
43 | and 1 resident of the state who falls into none of the foregoing |
44 | classifications. Prior to the appointment, the sheriff, chief of |
45 | police, law enforcement officer, and correctional officer |
46 | members must shall have had at least 4 years' experience as law |
47 | enforcement officers or correctional officers. |
48 | (b) The Governor, in making appointments under this |
49 | section, shall take into consideration representation by |
50 | geography, population, and other relevant factors in order that |
51 | the representation on the commission be apportioned to give |
52 | representation to the state at large rather than to a particular |
53 | area. Of the appointed members, and except for correctional |
54 | officers of a state institution, there may be only one |
55 | appointment from any employing agency. |
56 | 1. In appointing the 3 sheriffs, the Governor shall choose |
57 | each appointment from a list of 6 nominees submitted by the |
58 | Florida Sheriffs Association. The Florida Sheriffs Association |
59 | shall submit its list of 6 nominees at least 3 months before the |
60 | expiration of the term of any sheriff member. |
61 | 2. In appointing the 3 chiefs of police, the Governor |
62 | shall choose each appointment from a list of 6 nominees |
63 | submitted by the Florida Police Chiefs Association. The Florida |
64 | Police Chiefs Association shall submit its list of 6 nominees at |
65 | least 3 months before the expiration of the term of any police |
66 | chief member. |
67 | 3. In appointing the 5 law enforcement officers and 1 |
68 | correctional officer of the rank of sergeant or below, the |
69 | Governor shall choose each appointment from a list of 6 nominees |
70 | submitted by a committee comprised of 3 members of the |
71 | collective bargaining agent for the largest number of certified |
72 | law enforcement bargaining units, 2 members of the collective |
73 | bargaining agent for the second largest number of certified law |
74 | enforcement bargaining units, and 1 member of the collective |
75 | bargaining agent of the third largest number of certified law |
76 | enforcement bargaining units. At least one of the names |
77 | submitted for each of the five appointments who are law |
78 | enforcement officers must be an officer who is not in a |
79 | collective bargaining unit represented on the committee. The |
80 | committee shall submit its list of 6 nominees at least 3 months |
81 | before the expiration of the term of any law enforcement or |
82 | correctional officer member of the rank of sergeant or below. |
83 | Section 2. This act shall take effect upon becoming a law. |
