19  1002.20, Florida Statutes, is amended to read:
20         1002.20  K-12 student and parent rights.--Parents of
21  public school students must receive accurate and timely
22  information regarding their child's academic progress and must
23  be informed of ways they can help their child to succeed in
24  school. K-12 students and their parents are afforded numerous
25  statutory rights including, but not limited to, the following:
26         (6)  EDUCATIONAL CHOICE.--
27         (a)  Public school choices.--Parents of public school
28  students may seek whatever public school choice options that
29  are applicable to their students and are available to students
30  in their school districts. These options may include
31  controlled open enrollment, lab schools, charter schools,

These options may 9 also include the public school choice options of the 10 Opportunity Scholarship Program and the McKay Scholarships for 11 Students with Disabilities Program. 12 Section 2. Paragraph (d) of subsection (2) of section 13 1002.23, Florida Statutes, is amended to read: 14 1002.23 Family and School Partnership for Student 15 Achievement Act.-- 16 (2) To facilitate meaningful parent and family 17 involvement, the Department of Education shall develop 18 guidelines for a parent guide to successful student 19 achievement which describes what parents need to know about 20 their child's educational progress and how they can help their 21 child to succeed in school. The guidelines shall include, but 22 need not be limited to: 23 (d) Opportunities for parents to learn about rigorous 24 academic programs that may be available for their child, such 25 as honors programs, dual enrollment, advanced placement, 26 International Baccalaureate, International General Certificate 27 of Secondary Education (pre-AICE), Advanced International 28 Certificate of Education, Florida Virtual High School courses, 29 and accelerated access to postsecondary education; 30 Section 3. Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 664 Barcode 303760 1 1007.22 Articulation; postsecondary institution 2 coordination and collaboration.-- 3 (2) The levels of postsecondary education shall 4 collaborate in further developing and providing articulated 5 programs in which students can proceed toward their 6 educational objectives as rapidly as their circumstances 7 permit. Time-shortened educational programs, as well as the 8 use of acceleration mechanisms, shall include, but not be 9 limited to, the International Baccalaureate, Advanced 10 International Certificate of Education, credit by examination 11 or demonstration of competency, advanced placement, early 12 admissions, and dual enrollment. 13 Section 4. Subsection (10) of section 1007.261, 14 Florida Statutes, is amended to read: 15 1007.261 State universities; admissions of 16 students.--Each university board of trustees is authorized to 17 adopt rules governing the admission of students, subject to 18 this section and rules of the State Board of Education. 19 (10) A Florida resident who is denied admission as an 20 undergraduate to a state university for failure to meet the 21 high school grade point average requirement may appeal the 22 decision to the university and request a recalculation of the 23 grade point average including in the revised calculation the 24 grades earned in up to three credits of advanced fine arts 25 courses. The university shall provide the student with a 26 description of the appeals process at the same time as 27 notification of the admissions decision. The university shall 28 recalculate the student's grade point average using the 29 additional courses and advise the student of any changes in 30 the student's admission status. Advanced level fine arts courses 3 include fine arts courses identified in the course code 4 directory as Advanced Placement, pre-International 5 Baccalaureate, or International Baccalaureate, International 6 General Certificate of Secondary Education (pre-AICE), or 7 Advanced International Certificate of Education, or fine arts 8 courses taken in the third or fourth year of a fine arts 9 curriculum. 10 Section 5. Subsection (9) of section 1007.27, Florida 11 Statutes, is amended to read: 12 1007.27 Articulated acceleration mechanisms.-- 13 (9) The Advanced International Certificate of 14 Education Program and the International General Certificate of 15 Secondary Education (pre-AICE) Program shall be the curricula 16 curriculum in which eligible secondary students are enrolled 17 in programs of study a program of studies offered through the 18 Advanced International Certificate of Education Program or the 19 International General Certificate of Secondary Education 20 (pre-AICE) Program administered by the University of Cambridge 21 Local Examinations Syndicate. The State Board of Education 22 shall establish rules which specify the cutoff scores and 23 Advanced International Certificate of Education examinations 24 which will be used to grant postsecondary credit at community 25 colleges and universities. Any such rules, which have the 26 effect of raising the required cutoff score or of changing the 27 Advanced International Certification of Education examinations 28 which will be used to grant postsecondary credit, shall apply 29 to students taking Advanced International Certificate of 30 Education examinations after such rules are adopted by the 31 State Board of Education. Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 664 Barcode 303760 1 of 30 semester credit hours pursuant to this subsection. The 2 specific course for which a student receives such credit shall 3 be determined by the community college or university that 4 accepts the student for admission. Students enrolled in either 5 program of study pursuant to this subsection shall be exempt 6 from the payment of any fees for administration of the 7 examinations regardless of whether or not the student achieves 8 a passing score on the examination. 9 Section 6. Section 1007.271, Florida Statutes, is 10 amended to read: 11 1007.271 Dual enrollment programs.-- 12 (1) The dual enrollment program is the enrollment of 13 an eligible secondary student or home education student in a 14 postsecondary course creditable toward high school graduation 15 and a career certificate or an associate or baccalaureate 16 degree. 17 (2) For the purpose of this section, an eligible 18 secondary student is a student who is enrolled in a Florida 19 public secondary school or in a Florida private secondary 20 school which is in compliance with s. 1002.42(2) and conducts 21 a secondary curriculum under pursuant to s. 1003.43. Students 22 enrolled in postsecondary instruction that is not creditable 23 toward the high school diploma shall not be classified as dual 24 enrollments. Students who are eligible for dual enrollment 25 under pursuant to this section shall be permitted to enroll in 26 dual enrollment courses conducted during school hours, after 27 school hours, and during the summer term. Instructional time 28 for the such enrollment may vary from exceed 900 hours; 29 however, the school district may only report the student for a 30 maximum of 1.0 FTE, as provided in s. 1011.61(4). Any 3 student so enrolled is exempt from the payment of 4 registration, tuition, and laboratory fees. 5 Vocational-preparatory instruction, college-preparatory 6 instruction and other forms of precollegiate instruction, as 7 well as physical education courses that focus on the physical 8 execution of a skill rather than the intellectual attributes 9 of the activity, are ineligible for inclusion in the dual 10 enrollment program. Recreation and leisure studies courses 11 shall be evaluated individually in the same manner as physical 12 education courses for potential inclusion in the program. 13 (3) The Department of Education shall adopt guidelines 14 designed to achieve comparability across school districts of 15 both student qualifications and teacher qualifications for 16 dual enrollment courses. Student qualifications must 17 demonstrate readiness for college-level coursework if the 18 student is to be enrolled in college courses. Student 19 qualifications must demonstrate readiness for career-level 20 coursework if the student is to be enrolled in career courses. 21 In addition to the common placement examination, student 22 qualifications for enrollment in college credit dual 23 enrollment courses must include a 3.0 unweighted grade point 24 average, and student qualifications for enrollment in career 25 certificate dual enrollment courses must include a 2.0 26 unweighted grade point average. Exceptions to the required 27 grade point averages may be granted if the educational 28 entities agree and the terms of the agreement are contained 29 within the dual enrollment interinstitutional articulation 30 agreement. Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 664 Barcode 303760 1 district interinstitutional articulation agreement developed 2 according to s. 1007.235, to ensure student readiness for 3 postsecondary instruction. Additional requirements included in 4 the agreement may shall not arbitrarily prohibit students who 5 have demonstrated the ability to master advanced courses from 6 participating in dual enrollment courses. District school 7 boards may not refuse to enter into an agreement with a local 8 community college if that community college has the capacity 9 to offer dual enrollment courses. 10 (4) Career dual enrollment shall be provided as a 11 curricular option for secondary students to pursue in order to 12 earn a series of elective credits toward the high school 13 diploma. However, career dual enrollment shall not supplant 14 student acquisition of the diploma. Career dual enrollment 15 shall be available for secondary students seeking a degree or 16 certificate from a complete career-preparatory program, and 17 may but shall not be used to enroll students sustain student 18 enrollment in isolated career courses. It is the intent of the 19 Legislature that career dual enrollment provide reflect the 20 interests and aptitudes of the student. The provision of a 21 comprehensive academic and career dual enrollment program 22 within the career center or community college is supportive of 23 legislative intent; however, such provision is not mandatory. 24 (5) Each district school board shall inform all 25 secondary students of dual enrollment as an educational option 26 and mechanism for acceleration. Students shall be informed of 27 eligibility criteria, the option for taking dual enrollment 28 courses beyond the regular school year, and the 24 minimum 29 academic credits required for graduation. Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 664 Barcode 303760 1 shall consider strategies and programs to meet that demand. 2 (6) The Commissioner of Education shall appoint 3 faculty committees representing public school, community 4 college, and university faculties to identify postsecondary 5 courses that meet the high school graduation requirements of 6 s. 1003.43, and to establish the number of postsecondary 7 semester credit hours of instruction and equivalent high 8 school credits earned through dual enrollment under pursuant 9 to this section that are necessary to meet high school 10 graduation requirements. The Such equivalencies shall be 11 determined solely on comparable course content and not on seat 12 time traditionally allocated to the such courses in high 13 school. The Commissioner of Education shall recommend to the 14 State Board of Education those postsecondary courses 15 identified to meet high school graduation requirements, based 16 on mastery of course outcomes, by their statewide course 17 number, and all high schools shall accept these postsecondary 18 education courses toward meeting the requirements of s. 19 1003.43. 20 (7) Early admission shall be a form of dual enrollment 21 through which eligible secondary students enroll in a 22 postsecondary institution on a full-time basis in courses that 23 are creditable toward the high school diploma and the 24 associate or baccalaureate degree. Students enrolled under 25 pursuant to this subsection are shall be exempt from the 26 payment of registration, tuition, and laboratory fees. 27 (8) Career early admission is a form of career dual 28 enrollment through which eligible secondary students enroll 29 full time in a career center or a community college in courses 30 that are creditable toward the high school diploma and the 31 certificate or associate degree. Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 664 Barcode 303760 1 early admission program shall be limited to students who have 2 completed a minimum of 6 semesters of full-time secondary 3 enrollment, including studies undertaken in the ninth grade. 4 Students enrolled under pursuant to this section are exempt 5 from the payment of registration, tuition, and laboratory 6 fees. 7 (9) The State Board of Education shall adopt rules for 8 any dual enrollment programs involving requirements for high 9 school graduation. 10 (10)(a) The dual enrollment program for home education 11 students consists of the enrollment of an eligible home 12 education secondary student in a postsecondary course 13 creditable toward an associate degree, a career certificate, 14 or a baccalaureate degree. To participate in the dual 15 enrollment program, an eligible home education secondary 16 student must: 17 1. Provide proof of enrollment in a home education 18 program under pursuant to s. 1002.41. 19 2. Be responsible for his or her own instructional 20 materials and transportation unless provided for otherwise. 21 (b) Each career center, community college, and state 22 university shall: 23 1. Delineate courses and programs for dually enrolled 24 home education students. Courses and programs may be added, 25 revised, or deleted at any time. 26 2. Identify eligibility criteria for home education 27 student participation, not to exceed those required of other 28 dually enrolled students. 29 (11) The Department of Education shall approve any 30 course for inclusion in the dual enrollment program that is 31 contained within the statewide course numbering system. 9 3:50 PM 02/21/05 s0664d-ed09-c8u
Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 664 Barcode 303760 1 However, college-preparatory and other forms of precollegiate 2 instruction, and physical education and other courses that 3 focus on the physical execution of a skill rather than the 4 intellectual attributes of the activity, may not be so 5 approved, but must be evaluated individually for potential 6 inclusion in the dual enrollment program. This subsection does 7 not mean that an independent postsecondary institution 8 eligible for inclusion in the dual enrollment or early 9 admission program under s. 1011.62, must participate in the 10 state course numbering system authorized by s. 1007.24, in 11 order to participate in a dual enrollment program. 12 (12) The Department of Education shall develop a 13 statement on transfer guarantees which will inform students, 14 before enrolling prior to enrollment in a dual enrollment 15 course, of the potential for the dual enrollment course to 16 articulate as an elective or a general education course into a 17 postsecondary education certificate or degree program. The 18 statement shall be provided to each district school 19 superintendent, who shall include the statement in the 20 information provided to all secondary students as required 21 under pursuant to this subsection. The statement may also 22 include additional information, including, but not limited to, 23 dual enrollment options, guarantees, privileges, and 24 responsibilities. 25 (13) It is the intent of the Legislature that Students 26 who meet the eligibility requirements of this subsection and 27 who choose to participate in dual enrollment programs are be 28 exempt from the payment of registration, tuition, and 29 laboratory fees. 30 (14) Instructional materials assigned for use within 31 dual enrollment courses must shall be made available to dual 10 3:50 PM 02/21/05 s0664d-ed09-c8u

This subsection does shall not be construed to 3 prohibit a community college from providing instructional 4 materials at no cost to a home education student or student 5 from a private school. Students enrolled in postsecondary 6 instruction not creditable toward a high school diploma may 7 shall not be considered dual enrollments and are shall be 8 required to assume the cost of instructional materials 9 necessary for this such instruction. 10 (15) Instructional materials purchased by a district 11 school board or community college board of trustees on behalf 12 of dual enrollment students shall be the property of the board 13 against which the purchase is charged. 14 (16) School districts and community colleges must 15 weigh college-level dual enrollment courses the same as honors 16 courses and advanced placement courses when grade point 17 averages are calculated. Alternative grade calculation or 18 weighting systems that discriminate against dual enrollment 19 courses are prohibited. 20 (17) The Commissioner of Education may approve dual 21 enrollment agreements for limited course offerings that have 22 statewide appeal. Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 664 Barcode 303760 1 courses: 2 (a) Courses identified in the course code directory as 3 Advanced Placement, pre-International Baccalaureate, or 4 International Baccalaureate, International General Certificate 5 of Secondary Education (pre-AICE), or Advanced International 6 Certificate of Education. 7 8 The department may assign additional weights to courses, other 9 than those described in paragraphs (a) and (b), that are 10 identified by the Department of Education as containing 11 rigorous academic curriculum and performance standards. The 12 additional weight assigned to a course pursuant to this 13 subsection shall not exceed 0.5 per course. The weighted 14 system shall be developed and distributed to all high schools 15 in the state prior to January 1, 1998. The department may 16 determine a student's eligibility status during the senior 17 year before graduation and may inform the student of the award 18 at that time. 19 Section 8. Subsection (1) of section 1009.534, Florida 20 Statutes, is amended to read: 21 1009.534 Florida Academic Scholars award.-- 22 (1) A student is eligible for a Florida Academic 23 Scholars award if the student meets the general eligibility 24 requirements for the Florida Bright Futures Scholarship 25 Program and the student: 26 (a) Has achieved a 3.5 weighted grade point average as 27 calculated pursuant to s. 1009.531, or its equivalent, in high 28 school courses that are designated by the State Board of 29 Education as college-preparatory academic courses; and has 30 attained at least the score identified by rules of the State 31 Board of Education on the combined verbal and quantitative 12 3:50 PM 02/21/05 s0664d-ed09-c8u

Paragraphs (i) and (m) of subsection (1) 13 of section 1011.62, Florida Statutes, are amended, paragraphs 14 (n), (o), (p), (q), and (r) of that subsection are 15 redesignated as paragraphs (o), (p), (q), (r), and (s), 16 respectively, and a new paragraph (n) is added to that 17 subsection, to read: 18 1011.62 Funds for operation of schools.--If the annual 19 allocation from the Florida Education Finance Program to each 20 district for operation of schools is not determined in the 21 annual appropriations act or the substantive bill implementing 22 the annual appropriations act, it shall be determined as 23 follows: 24 (1) COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR 25 OPERATION.--The following procedure shall be followed in 26 determining the annual allocation to each district for 27 operation: 28 (i) Calculation of full-time equivalent membership 29 with respect to instruction from community colleges or state 30 universities.--Students enrolled in community college or 31 university dual enrollment instruction under pursuant to s. 15 3:50 PM 02/21/05 s0664d-ed09-c8u

Each semester of 4 instruction that generates high school and postsecondary 5 credit shall be reported by school districts as 75 membership 6 hours for purposes of FTE calculation. The Such students may 7 also be calculated as the proportional shares of full-time 8 equivalent enrollments they generate for the community college 9 or university conducting the dual enrollment instruction. 10 Early admission students shall be considered dual enrollments 11 for funding purposes. Students may be enrolled in dual 12 enrollment instruction provided by an eligible independent 13 college or university and may be included in calculations of 14 full-time equivalent student memberships for basic programs 15 for grades 9 through 12 by a district school board. However, 16 those provisions of law which exempt dual enrolled and early 17 admission students from payment of instructional materials and 18 tuition and fees, including laboratory fees, do shall not 19 apply to students who select the option of enrolling in an 20 eligible independent institution. A value of 11 0.12 full-time equivalent student membership shall be 12 calculated for each student enrolled in a half-credit Advanced 13 International Certificate of Education course who receives a 14 score of E 1 or higher on a subject examination. A value of 15 0.3 full-time equivalent student membership shall be 16 calculated for each student who receives received an Advanced 17 International Certificate of Education diploma. Such value 18 shall be added to the total full-time equivalent student 19 membership in basic programs for grades 9 through 12 in the 20 subsequent fiscal year. For the purpose of incorporating the 9 amendment to section 1011.62, Florida Statutes, in a reference 10 thereto, subsection (2) of section 1011.69, Florida Statutes, 11 is reenacted to read: 12 1011.69 Equity in School-Level Funding Act.-- 13 (2) Beginning in the 2003-2004 fiscal year, district 14 school boards shall allocate to schools within the district an 15 average of 90 percent of the funds generated by all schools 16 and guarantee that each school receives at least 80 percent of 17 the funds generated by that school based upon the Florida 18 Education Finance Program as provided in s. 1011.62 and the 19 General Appropriations Act, including gross state and local 20 funds, discretionary lottery funds, and funds from the school 21 district's current operating discretionary millage levy. Total 22 funding for each school shall be recalculated during the year 23 to reflect the revised calculations under the Florida 24 Education Finance Program by the state and the actual weighted 25 full-time equivalent students reported by the school during 26 the full-time equivalent student survey periods designated by 27 the Commissioner of Education. If the district school board is 28 providing programs or services to students funded by federal 29 funds, any eligible students enrolled in the schools in the 30 district shall be provided federal funds.
