18         Section 1.  Paragraph (a) of subsection (6) of section
19  1002.20, Florida Statutes, is amended to read:
20         1002.20  K-12 student and parent rights.--Parents of
21  public school students must receive accurate and timely
22  information regarding their child's academic progress and must
23  be informed of ways they can help their child to succeed in
24  school. K-12 students and their parents are afforded numerous
25  statutory rights including, but not limited to, the following:
26         (6)  EDUCATIONAL CHOICE.--
27         (a)  Public school choices.--Parents of public school
28  students may seek whatever public school choice options that
29  are applicable to their students and are available to students
30  in their school districts. These options may include
31  controlled open enrollment, lab schools, charter schools,

These options may 9 also include the public school choice options of the 10 Opportunity Scholarship Program and the McKay Scholarships for 11 Students with Disabilities Program. 12 Section 2. Paragraph (d) of subsection (2) of section 13 1002.23, Florida Statutes, is amended to read: 14 1002.23 Family and School Partnership for Student 15 Achievement Act.-- 16 (2) To facilitate meaningful parent and family 17 involvement, the Department of Education shall develop 18 guidelines for a parent guide to successful student 19 achievement which describes what parents need to know about 20 their child's educational progress and how they can help their 21 child to succeed in school. The guidelines shall include, but 22 need not be limited to: 23 (d) Opportunities for parents to learn about rigorous 24 academic programs that may be available for their child, such 25 as honors programs, dual enrollment, advanced placement, 26 International Baccalaureate, International General Certificate 27 of Secondary Education (pre-AICE), Advanced International 28 Certificate of Education, Florida Virtual High School courses, 29 and accelerated access to postsecondary education; 30 Section 3. Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 664 Barcode 360740 1 1007.22 Articulation; postsecondary institution 2 coordination and collaboration.-- 3 (2) The levels of postsecondary education shall 4 collaborate in further developing and providing articulated 5 programs in which students can proceed toward their 6 educational objectives as rapidly as their circumstances 7 permit. Time-shortened educational programs, as well as the 8 use of acceleration mechanisms, shall include, but not be 9 limited to, the International Baccalaureate, Advanced 10 International Certificate of Education, credit by examination 11 or demonstration of competency, advanced placement, early 12 admissions, and dual enrollment. 13 Section 4. Subsection (10) of section 1007.261, 14 Florida Statutes, is amended to read: 15 1007.261 State universities; admissions of 16 students.--Each university board of trustees is authorized to 17 adopt rules governing the admission of students, subject to 18 this section and rules of the State Board of Education. 19 (10) A Florida resident who is denied admission as an 20 undergraduate to a state university for failure to meet the 21 high school grade point average requirement may appeal the 22 decision to the university and request a recalculation of the 23 grade point average including in the revised calculation the 24 grades earned in up to three credits of advanced fine arts 25 courses. The university shall provide the student with a 26 description of the appeals process at the same time as 27 notification of the admissions decision. The university shall 28 recalculate the student's grade point average using the 29 additional courses and advise the student of any changes in 30 the student's admission status. Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 664 Barcode 360740 1 sculpture, speech, debate, or a course in any art form that 2 requires manual dexterity. Advanced level fine arts courses 3 include fine arts courses identified in the course code 4 directory as Advanced Placement, pre-International 5 Baccalaureate, or International Baccalaureate, International 6 General Certificate of Secondary Education (pre-AICE), or 7 Advanced International Certificate of Education, or fine arts 8 courses taken in the third or fourth year of a fine arts 9 curriculum. 10 Section 5. Subsection (9) of section 1007.27, Florida 11 Statutes, is amended to read: 12 1007.27 Articulated acceleration mechanisms.-- 13 (9) The Advanced International Certificate of 14 Education Program and the International General Certificate of 15 Secondary Education (pre-AICE) Program shall be the curricula 16 curriculum in which eligible secondary students are enrolled 17 in programs of study a program of studies offered through the 18 Advanced International Certificate of Education Program or the 19 International General Certificate of Secondary Education 20 (pre-AICE) Program administered by the University of Cambridge 21 Local Examinations Syndicate. The State Board of Education 22 shall establish rules which specify the cutoff scores and 23 Advanced International Certificate of Education examinations 24 which will be used to grant postsecondary credit at community 25 colleges and universities. Any such rules, which have the 26 effect of raising the required cutoff score or of changing the 27 Advanced International Certification of Education examinations 28 which will be used to grant postsecondary credit, shall apply 29 to students taking Advanced International Certificate of 30 Education examinations after such rules are adopted by the 31 State Board of Education. Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 664 Barcode 360740 1 of 30 semester credit hours pursuant to this subsection. The 2 specific course for which a student receives such credit shall 3 be determined by the community college or university that 4 accepts the student for admission. Students enrolled in either 5 program of study pursuant to this subsection shall be exempt 6 from the payment of any fees for administration of the 7 examinations regardless of whether or not the student achieves 8 a passing score on the examination. 9 Section 6. Paragraph (a) of subsection (3) of section 10 1009.531, Florida Statutes, is amended to read: 11 1009.531 Florida Bright Futures Scholarship Program; 12 student eligibility requirements for initial awards.-- 13 (3) For purposes of calculating the grade point 14 average to be used in determining initial eligibility for a 15 Florida Bright Futures Scholarship, the department shall 16 assign additional weights to grades earned in the following 17 courses: 18 (a) Courses identified in the course code directory as 19 Advanced Placement, pre-International Baccalaureate, or 20 International Baccalaureate, International General Certificate 21 of Secondary Education (pre-AICE), or Advanced International 22 Certificate of Education. 23 The department may assign additional weights to 24 courses, other than those described in paragraphs (a) and (b), 25 that are identified by the Department of Education as 26 containing rigorous academic curriculum and performance 27 standards. The additional weight assigned to a course pursuant 28 to this subsection shall not exceed 0.5 per course. The 29 weighted system shall be developed and distributed to all high 30 schools in the state prior to January 1, 1998. Subsection (1) of section 1009.534, Florida 4 Statutes, is amended to read: 5 1009.534 Florida Academic Scholars award.-- 6 (1) A student is eligible for a Florida Academic 7 Scholars award if the student meets the general eligibility 8 requirements for the Florida Bright Futures Scholarship 9 Program and the student: 10 (a) Has achieved a 3.5 weighted grade point average as 11 calculated pursuant to s. 1009.531, or its equivalent, in high 12 school courses that are designated by the State Board of 13 Education as college-preparatory academic courses; and has 14 attained at least the score identified by rules of the State 15 Board of Education on the combined verbal and quantitative 16 parts of the Scholastic Aptitude Test, the Scholastic 17 Assessment Test, or the recentered Scholastic Assessment Test 18 of the College Entrance Examination, or an equivalent score on 19 the ACT Assessment Program; or 20 (b) Has attended a home education program according to 21 s. 1002.41 during grades 11 and 12 or has completed the 22 International Baccalaureate curriculum but failed to earn the 23 International Baccalaureate Diploma or has completed the 24 Advanced International Certificate of Education curriculum but 25 failed to earn the Advanced International Certificate of 26 Education Diploma, and has attained at least the score 27 identified by rules of the State Board of Education on the 28 combined verbal and quantitative parts of the Scholastic 29 Aptitude Test, the Scholastic Assessment Test, or the 30 recentered Scholastic Assessment Test of the College Entrance 31 Examination, or an equivalent score on the ACT Assessment 6 8:46 AM 02/21/05 s0664.ed09.0aa
Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 664 Barcode 360740 1 Program; or 2 (c) Has been awarded an International Baccalaureate 3 Diploma from the International Baccalaureate Office or an 4 Advanced International Certificate of Education Diploma from 5 the University of Cambridge International Examinations Office 6 ; or 7 (d) Has been recognized by the merit or achievement 8 programs of the National Merit Scholarship Corporation as a 9 scholar or finalist; or 10 (e) Has been recognized by the National Hispanic 11 Recognition Program as a scholar recipient. 12 A student must complete a program of community service 13 work, as approved by the district school board or the 14 administrators of a nonpublic school, which shall include a 15 minimum of 75 hours of service work and require the student to 16 identify a social problem that interests him or her, develop a 17 plan for his or her personal involvement in addressing the 18 problem, and, through papers or other presentations, evaluate 19 and reflect upon his or her experience. 20 Section 8. Subsection (1) of section 1009.535, Florida 21 Statutes, is amended to read: 22 1009.535 Florida Medallion Scholars award.-- 23 (1) A student is eligible for a Florida Medallion 24 Scholars award if the student meets the general eligibility 25 requirements for the Florida Bright Futures Scholarship 26 Program and the student: 27 (a) Has achieved a weighted grade point average of 3.0 28 as calculated pursuant to s. 1009.531, or the equivalent, in 29 high school courses that are designated by the State Board of 30 Education as college-preparatory academic courses; and has 31 attained at least the score identified by rules of the State 7 8:46 AM 02/21/05 s0664.ed09.0aa

Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 664 Barcode 360740 1 allocation from the Florida Education Finance Program to each 2 district for operation of schools is not determined in the 3 annual appropriations act or the substantive bill implementing 4 the annual appropriations act, it shall be determined as 5 follows: 6 (1) COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR 7 OPERATION.--The following procedure shall be followed in 8 determining the annual allocation to each district for 9 operation: 10 (m) Calculation of additional full-time equivalent 11 membership based on Advanced International Certificate of 12 Education examination scores of students.--A value of 0.24 13 full-time equivalent student membership shall be calculated 14 for each student enrolled in a full-credit Advanced 15 International Certificate of Education course who receives a 16 score of E 2 or higher on a subject examination. A value of 17 0.12 full-time equivalent student membership shall be 18 calculated for each student enrolled in a half-credit Advanced 19 International Certificate of Education course who receives a 20 score of E 1 or higher on a subject examination. A value of 21 0.3 full-time equivalent student membership shall be 22 calculated for each student who receives received an Advanced 23 International Certificate of Education diploma. Such value 24 shall be added to the total full-time equivalent student 25 membership in basic programs for grades 9 through 12 in the 26 subsequent fiscal year. The school district shall distribute 27 to each classroom teacher who provided Advanced International 28 Certificate of Education instruction: 29 1. A bonus in the amount of $25 for each student 4 taught by the Advanced International Certificate of Education 5 teacher in each half-credit Advanced International Certificate 6 of Education course who receives a score of E 1 or higher on 7 the Advanced International Certificate of Education 8 examination. 9 2. An additional bonus of $500 to each Advanced 10 International Certificate of Education teacher in a school 11 designated performance grade category "D" or "F" who has at 12 least one student scoring E 2 or higher on the full-credit 13 Advanced International Certificate of Education examination, 14 regardless of the number of classes taught or of the number of 15 students scoring an E a 2 or higher on the full-credit 16 Advanced International Certificate of Education examination. 17 3. Additional bonuses of $250 each to teachers of 18 half-credit Advanced International Certificate of Education 19 classes in a school designated performance grade category "D" 20 or " F" which has at least one student scoring an E a 1 or 21 higher on the half-credit Advanced International Certificate 22 of Education examination in that class. The maximum additional 23 bonus for a teacher awarded in accordance with this 24 subparagraph shall not exceed $500 in any given school year. 25 Teachers receiving an award under subparagraph 2. are not 26 eligible for a bonus under this subparagraph. 27 Bonuses awarded to a teacher according to this 28 paragraph shall not exceed $2,000 in any given school year and 29 shall be in addition to any regular wage or other bonus the 30 teacher received or is scheduled to receive. 31 (n) Calculation of additional full-time equivalent 10 8:46 AM 02/21/05 s0664.ed09.0aa
Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 664 Barcode 360740 1 membership based on International General Certificate of 2 Secondary Education examination scores of students.--A value 3 of 0.12 full-time equivalent student membership shall be 4 calculated for each student enrolled in an International 5 General Certificate of Secondary Education (pre-AICE) course 6 who receives a score of E or higher on a subject examination. 7 A value of 0.15 full-time equivalent student membership shall 8 be calculated for each student who receives an International 9 Certificate of Education diploma. Such value shall be added to 10 the total full-time equivalent student membership in basic 11 programs for grades 9 through 12 in the subsequent fiscal 12 year. 13 Section 10. For the purpose of incorporating the 14 amendment to section 1011.62, Florida Statutes, in a reference 15 thereto, subsection (2) of section 1011.69, Florida Statutes, 16 is reenacted to read: 17 1011.69 Equity in School-Level Funding Act.-- 18 (2) Beginning in the 2003-2004 fiscal year, district 19 school boards shall allocate to schools within the district an 20 average of 90 percent of the funds generated by all schools 21 and guarantee that each school receives at least 80 percent of 22 the funds generated by that school based upon the Florida 23 Education Finance Program as provided in s. 1011.62 and the 24 General Appropriations Act, including gross state and local 25 funds, discretionary lottery funds, and funds from the school 26 district's current operating discretionary millage levy. Total 27 funding for each school shall be recalculated during the year 28 to reflect the revised calculations under the Florida 29 Education Finance Program by the state and the actual weighted 30 full-time equivalent students reported by the school during 31 the full-time equivalent student survey periods designated by 11 8:46 AM 02/21/05 s0664.ed09.0aa

If the district school board is 2 providing programs or services to students funded by federal 3 funds, any eligible students enrolled in the schools in the 4 district shall be provided federal funds. Only academic 5 performance-based charter school districts, pursuant to s. 6 1003.62, are exempt from the provisions of this section. 7 Section 11.
