18 Section 1. Paragraph (a) of subsection (6) of section
19 1002.20, Florida Statutes, is amended to read:
20 1002.20 K-12 student and parent rights.--Parents of
21 public school students must receive accurate and timely
22 information regarding their child's academic progress and must
23 be informed of ways they can help their child to succeed in
24 school. K-12 students and their parents are afforded numerous
25 statutory rights including, but not limited to, the following:
26 (6) EDUCATIONAL CHOICE.--
27 (a) Public school choices.--Parents of public school
28 students may seek whatever public school choice options that
29 are applicable to their students and are available to students
30 in their school districts. These options may include
31 controlled open enrollment, lab schools, charter schools,

1 charter technical career centers, magnet schools, alternative
2 schools, special programs, advanced placement, dual

5 International Certificate of Education, early admissions,
6 credit by examination or demonstration of competency, the New
7 World School of the Arts, the Florida School for the Deaf and
8 the Blind, and the Florida Virtual School. These options may
9 also include the public school choice options of the
10 Opportunity Scholarship Program and the McKay Scholarships for
11 Students with Disabilities Program.
12 Section 2. Subsection (2) of section 1002.23, Florida
13 Statutes, is amended to read:
14 1002.23 Family and School Partnership for Student
15 Achievement Act.--
16 (2) To facilitate meaningful parent and family
17 involvement, the Department of Education shall develop
18 guidelines for a parent guide to successful student
19 achievement which describes what parents need to know about
20 their child's educational progress and how they can help their
21 child to succeed in school. The guidelines shall include, but
22 need not be limited to:
23 (a) Parental information regarding:
24 1. Requirements for their child to be promoted to the
25 next grade, as provided for in s. 1008.25;
26 2. Progress of their child toward achieving state and
27 district expectations for academic proficiency;
28 3. Assessment results, including report cards and
29 progress reports; and
30 4. Qualifications of their child's teachers;
31 (b) Services available for parents and their children,

1 such as family literacy services; mentoring, tutorial, and
2 other academic reinforcement programs; college planning,
3 academic advisement, and student counseling services; and
4 after-school programs;
5 (c) Opportunities for parental participation, such as
6 parenting classes, adult education, school advisory councils,
7 and school volunteer programs;
8 (d) Opportunities for parents to learn about rigorous
9 academic programs that may be available for their child, such
10 as honors programs, dual enrollment, advanced placement,
11 International Baccalaureate, International General Certificate
12 of Secondary Education (pre-AICE), Advanced International
13 Certificate of Education, Florida Virtual High School courses,
14 and accelerated access to postsecondary education;
15 (e) Educational choices, as provided for in s.
16 1002.20(6), and corporate income tax credit scholarships, as
17 provided for in s. 220.187;
18 (f) Classroom and test accommodations available for
19 students with disabilities; and
20 (g) School board rules, policies, and procedures for
21 student promotion and retention, academic standards, student
22 assessment, courses of study, instructional materials, and
23 contact information for school and district offices.
24 Section 3. Subsection (2) of section 1007.22, Florida
25 Statutes, is amended to read:
26 1007.22 Articulation; postsecondary institution
27 coordination and collaboration.--
28 (2) The levels of postsecondary education shall
29 collaborate in further developing and providing articulated
30 programs in which students can proceed toward their
31 educational objectives as rapidly as their circumstances

1 permit. Time-shortened educational programs, as well as the
2 use of acceleration mechanisms, shall include, but not be
3 limited to, the International Baccalaureate, Advanced
4 International Certificate of Education, credit by examination
5 or demonstration of competency, advanced placement, early
6 admissions, and dual enrollment.
7 Section 4. Subsection (10) of section 1007.261,
8 Florida Statutes, is amended to read:
9 1007.261 State universities; admissions of
10 students.--Each university board of trustees is authorized to
11 adopt rules governing the admission of students, subject to
12 this section and rules of the State Board of Education.
13 (10) A Florida resident who is denied admission as an
14 undergraduate to a state university for failure to meet the
15 high school grade point average requirement may appeal the
16 decision to the university and request a recalculation of the
17 grade point average including in the revised calculation the
18 grades earned in up to three credits of advanced fine arts
19 courses. The university shall provide the student with a
20 description of the appeals process at the same time as
21 notification of the admissions decision. The university shall
22 recalculate the student's grade point average using the
23 additional courses and advise the student of any changes in
24 the student's admission status. For purposes of this section,
25 fine arts courses include courses in music, drama, painting,
26 sculpture, speech, debate, or a course in any art form that
27 requires manual dexterity. Advanced level fine arts courses
28 include fine arts courses identified in the course code
29 directory as Advanced Placement, pre-International
30 Baccalaureate, or International Baccalaureate, International
31 General Certificate of Secondary Education (pre-AICE),

1 Advanced International Certificate of Education, or fine arts
2 courses taken in the third or fourth year of a fine arts
3 curriculum.
4 Section 5. Subsection (9) of section 1007.27, Florida
5 Statutes, is amended to read:
6 1007.27 Articulated acceleration mechanisms.--
7 (9) The Advanced International Certificate of
8 Education Program and the International General Certificate of
9 Secondary Education (pre-AICE) Program shall be the curricula
10 curriculum in which eligible secondary students are enrolled
11 in programs of study a program of studies offered through the
12 Advanced International Certificate of Education Program or the
13 International General Certificate of Secondary Education
14 (pre-AICE) Program administered by the University of Cambridge
15 Local Examinations Syndicate. The State Board of Education
16 shall establish rules which specify the cutoff scores and
17 Advanced International Certificate of Education examinations
18 which will be used to grant postsecondary credit at community
19 colleges and universities. Any such rules, which have the
20 effect of raising the required cutoff score or of changing the
21 Advanced International Certification of Education examinations
22 which will be used to grant postsecondary credit, shall apply
23 to students taking Advanced International Certificate of
24 Education Examinations after such rules are adopted by the
25 State Board of Education. Students shall be awarded a maximum
26 of 30 semester credit hours pursuant to this subsection. The
27 specific course for which a student receives such credit shall
28 be determined by the community college or university that
29 accepts the student for admission. Students enrolled in
30 either program of study pursuant to this subsection shall be
31 exempt from the payment of any fees for administration of the

1 examinations regardless of whether or not the student achieves
2 a passing score on the examination.
3 Section 6. Subsections (1), (2), (4), (5), (6), (11),
4 and (13) of section 1007.271, Florida Statutes, are amended to
5 read:
6 1007.271 Dual enrollment programs.--
7 (1) The dual enrollment program is the enrollment of
8 an eligible secondary student or home education student in a
9 postsecondary course creditable toward high school graduation
10 and a career certificate or an associate or baccalaureate
11 degree.
12 (2) For the purpose of this section, an eligible
13 secondary student is a student who is enrolled in a Florida
14 public secondary school or in a Florida private secondary
15 school which is in compliance with s. 1002.42(2) and conducts
16 a secondary curriculum pursuant to s. 1003.43. Students
17 enrolled in postsecondary instruction that is not creditable
18 toward the high school diploma shall not be classified as dual
19 enrollments. Students who are eligible for dual enrollment
20 pursuant to this section shall be permitted to enroll in dual
21 enrollment courses conducted during school hours, after school
22 hours, and during the summer term. Instructional time for such
23 enrollment may vary from exceed 900 hours; however, the school
24 district may only report the student for a maximum of 1.0 FTE,
25 as provided in s. 1011.61(4). Each semester of instruction
26 that generates high school and postsecondary credit shall be
27 reported by each school district as 75 membership hours for
28 purposes of FTE calculation. Any student so enrolled is exempt
29 from the payment of registration, tuition, and laboratory
30 fees. Vocational-preparatory instruction, college-preparatory
31 instruction and other forms of precollegiate instruction, as

1 well as physical education courses that focus on the physical
2 execution of a skill rather than the intellectual attributes
3 of the activity, are ineligible for inclusion in the dual
4 enrollment program. Recreation and leisure studies courses
5 shall be evaluated individually in the same manner as physical
6 education courses for potential inclusion in the program.
7 (4) Career dual enrollment shall be provided as a
8 curricular option for secondary students to pursue in order to
9 earn a series of elective credits toward the high school
10 diploma. However, career dual enrollment shall not supplant
11 student acquisition of the diploma. Career dual enrollment
12 shall be available for secondary students seeking a degree or
13 certificate from a complete career-preparatory program, and
14 may not be used to enroll students but shall not sustain
15 student enrollment in isolated career courses. It is the
16 intent of the Legislature that career dual enrollment provide
17 reflect the interests and aptitudes of the student. The
18 provision of a comprehensive academic and career dual
19 enrollment program within the career center or community
20 college is supportive of legislative intent; however, such
21 provision is not mandatory.
22 (5) Each district school board shall inform all
23 secondary students of dual enrollment as an educational option
24 and mechanism for acceleration. Students shall be informed of
25 eligibility criteria, the option for taking dual enrollment
26 courses beyond the regular school year, and the 24 minimum
27 academic credits required for graduation. District school
28 boards shall annually assess the demand for dual enrollment
29 and other advanced courses, and the district school board
30 shall consider strategies and programs to meet that demand.
31 (6) The Commissioner of Education shall appoint

1 faculty committees representing public school, community
2 college, and university faculties to identify postsecondary
3 courses that meet the high school graduation requirements of
4 s. 1003.43, and to establish the number of postsecondary
5 semester credit hours of instruction and equivalent high
6 school credits earned through dual enrollment pursuant to this
7 section that are necessary to meet high school graduation
8 requirements. Such equivalencies shall be determined solely on
9 comparable course content and not on seat time traditionally
10 allocated to such courses in high school. The Commissioner of
11 Education shall recommend to the State Board of Education
12 those post secondary courses identified to meet high school
13 graduation requirements, based on mastery of course outcomes,
14 by their statewide course number, and all high schools shall
15 accept these postsecondary education courses toward meeting
16 the requirements of s. 1003.43.
17 (11) The Department of Education shall approve any
18 course for inclusion in the dual enrollment program that is
19 contained within the statewide course numbering system.
20 However, college-preparatory and other forms of precollegiate
21 instruction, and physical education and other courses that
22 focus on the physical execution of a skill rather than the
23 intellectual attributes of the activity, may not be so
24 approved, but must be evaluated individually for potential
25 inclusion in the dual enrollment program. This subsection does
26 not mean that an independent postsecondary institution
27 eligible for inclusion in a dual enrollment or early admission
28 program pursuant to s. 1011.62 must participate in the
29 statewide course numbering system developed pursuant to s.
30 1007.24 to participate in a dual enrollment program.
31 (13) It is the intent of the Legislature that Students

1 who meet the eligibility requirements of this section
2 subsection and who choose to participate in dual enrollment
3 programs are be exempt from the payment of registration,
4 tuition, and laboratory fees.
5 Section 7. Subsection (3) of section 1009.531, Florida
6 Statutes, is amended to read:
7 1009.531 Florida Bright Futures Scholarship Program;
8 student eligibility requirements for initial awards.--
9 (3) For purposes of calculating the grade point
10 average to be used in determining initial eligibility for a
11 Florida Bright Futures Scholarship, the department shall
12 assign additional weights to grades earned in the following
13 courses:
14 (a) Courses identified in the course code directory as
15 Advanced Placement, pre-International Baccalaureate, or
16 International Baccalaureate, International General Certificate
17 of Secondary Education (pre-AICE), or Advanced International
18 Certificate of Education.
19 (b) Courses designated as academic dual enrollment
20 courses in the statewide course numbering system.
21
22 The department may assign additional weights to courses, other
23 than those described in paragraphs (a) and (b), that are
24 identified by the Department of Education as containing
25 rigorous academic curriculum and performance standards. The
26 additional weight assigned to a course pursuant to this
27 subsection shall not exceed 0.5 per course. The weighted
28 system shall be developed and distributed to all high schools
29 in the state prior to January 1, 1998. The department may
30 determine a student's eligibility status during the senior
31 year before graduation and may inform the student of the award

2 Section 8. Subsection (1) of section 1009.534, Florida
3 Statutes, is amended to read:
4 1009.534 Florida Academic Scholars award.--
5 (1) A student is eligible for a Florida Academic
6 Scholars award if the student meets the general eligibility
7 requirements for the Florida Bright Futures Scholarship
8 Program and the student:
9 (a) Has achieved a 3.5 weighted grade point average as
10 calculated pursuant to s. 1009.531, or its equivalent, in high
11 school courses that are designated by the State Board of
12 Education as college-preparatory academic courses; and has
13 attained at least the score identified by rules of the State
14 Board of Education on the combined verbal and quantitative
15 parts of the Scholastic Aptitude Test, the Scholastic
16 Assessment Test, or the recentered Scholastic Assessment Test
17 of the College Entrance Examination, or an equivalent score on
18 the ACT Assessment Program; or
19 (b) Has attended a home education program according to
20 s. 1002.41 during grades 11 and 12 or has completed the
21 International Baccalaureate curriculum but failed to earn the
22 International Baccalaureate Diploma or has completed the
23 Advanced International Certificate of Education curriculum but
24 failed to earn the Advanced International Certificate of
25 Education Diploma, and has attained at least the score
26 identified by rules of the State Board of Education on the
27 combined verbal and quantitative parts of the Scholastic
28 Aptitude Test, the Scholastic Assessment Test, or the
29 recentered Scholastic Assessment Test of the College Entrance
30 Examination, or an equivalent score on the ACT Assessment
31 Program; or

1 (c) Has been awarded an International Baccalaureate
2 Diploma from the International Baccalaureate Office or an
3 Advanced International Certificate of Education Diploma from
4 the University of Cambridge International Examinations Office;
5 or
6 (d) Has been recognized by the merit or achievement
7 programs of the National Merit Scholarship Corporation as a
8 scholar or finalist; or
9 (e) Has been recognized by the National Hispanic
10 Recognition Program as a scholar recipient.

12 A student must complete a program of community service work,
13 as approved by the district school board or the administrators
14 of a nonpublic school, which shall include a minimum of 75
15 hours of service work and require the student to identify a
16 social problem that interests him or her, develop a plan for
17 his or her personal involvement in addressing the problem,
18 and, through papers or other presentations, evaluate and
19 reflect upon his or her experience.
20 Section 9. Subsection (1) of section 1009.535, Florida
21 Statutes, is amended to read:
22 1009.535 Florida Medallion Scholars award.--
23 (1) A student is eligible for a Florida Medallion
24 Scholars award if the student meets the general eligibility
25 requirements for the Florida Bright Futures Scholarship
26 Program and the student:
27 (a) Has achieved a weighted grade point average of 3.0
28 as calculated pursuant to s. 1009.531, or the equivalent, in
29 high school courses that are designated by the State Board of
30 Education as college-preparatory academic courses; and has
31 attained at least the score identified by rules of the State

1 Board of Education on the combined verbal and quantitative
2 parts of the Scholastic Aptitude Test, the Scholastic

6 (b) Has attended a home education program according to
7 s. 1002.41 during grades 11 and 12 or has completed the

23 (d) Has been recognized by the National Hispanic
24 Recognition Program as a scholar, but has not completed a
25 program of community service as provided in s. 1009.534.
26 Section 10. Paragraphs (i) and (m) of subsection (1)
27 of section 1011.62, Florida Statutes, are amended and
28 paragraphs (n), (o), (p), (q), and (r) are redesignated as
29 paragraphs (o), (p), (q), (r), and (s), respectively, and a
30 new paragraph (n) is added to that subsection, to read:
31 1011.62 Funds for operation of schools.--If the annual

1 allocation from the Florida Education Finance Program to each
2 district for operation of schools is not determined in the
3 annual appropriations act or the substantive bill implementing
4 the annual appropriations act, it shall be determined as
5 follows:
6 (1) COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR
7 OPERATION.--The following procedure shall be followed in
8 determining the annual allocation to each district for
9 operation:
10 (i) Calculation of full-time equivalent membership
11 with respect to dual enrollment instruction from community
12 colleges or state universities.--Students enrolled in
13 community college or university dual enrollment instruction
14 pursuant to s. 1007.271 may be included in calculations of
15 full-time equivalent student memberships for basic programs
16 for grades 9 through 12 by a district school board. Each
17 semester of instruction that generates high school and
18 postsecondary credit shall be reported by each school district
19 as 75 membership hours for purposes of FTE calculation. Such
20 students may also be calculated as the proportional shares of
21 full-time equivalent enrollments they generate for a the
22 community college or university conducting the dual enrollment
23 instruction. Early admission students shall be considered dual
24 enrollments for funding purposes. Students may be enrolled in
25 dual enrollment instruction provided by an eligible
26 independent college or university and may be included in
27 calculations of full-time equivalent student memberships for
28 basic programs for grades 9 through 12 by a district school
29 board. However, those provisions of law which exempt dual
30 enrolled and early admission students from payment of
31 instructional materials and tuition and fees, including

1 laboratory fees, shall not apply to students who select the
2 option of enrolling in an eligible independent institution. An
3 independent college or university which is located and
4 chartered in Florida, is not for profit, is accredited by the
5 Commission on Colleges of the Southern Association of Colleges
6 and Schools or the Accrediting Council for Independent
7 Colleges and Schools, and which confers degrees as defined in
8 s. 1005.02 shall be eligible for inclusion in the dual
9 enrollment or early admission program. Students enrolled in
10 dual enrollment instruction shall be exempt from the payment
11 of tuition and fees, including laboratory fees. No student
12 enrolled in college credit mathematics or English dual
13 enrollment instruction shall be funded as a dual enrollment
14 unless the student has successfully completed the relevant
15 section of the entry-level examination required pursuant to s.
16 1008.30.
17 (m) Calculation of additional full-time equivalent
18 membership based on Advanced International Certificate of
19 Education examination scores of students.--A value of 0.24
20 full-time equivalent student membership shall be calculated
21 for each student enrolled in a full-credit Advanced
22 International Certificate of Education course who receives a
23 score of 2 or higher on a subject examination. A value of 0.12
24 full-time equivalent student membership shall be calculated
25 for each student enrolled in a half-credit Advanced
26 International Certificate of Education course who receives a
27 score of 1 or higher on a subject examination. A value of 0.3
28 full-time equivalent student membership shall be calculated
29 for each student who receives received an Advanced
30 International Certificate of Education diploma. Such value
31 shall be added to the total full-time equivalent student

1 membership in basic programs for grades 9 through 12 in the
2 subsequent fiscal year. The school district shall distribute
3 to each classroom teacher who provided Advanced International
4 Certificate of Education instruction:
5 1. A bonus in the amount of $50 for each student
6 taught by the Advanced International Certificate of Education
7 teacher in each full-credit Advanced International Certificate
8 of Education course who receives a score of E 2 or higher on
9 the Advanced International Certificate of Education
10 examination. A bonus in the amount of $25 for each student
11 taught by the Advanced International Certificate of Education
12 teacher in each half-credit Advanced International Certificate
13 of Education course who receives a score of E 1 or higher on
14 the Advanced International Certificate of Education
15 examination.
16 2. An additional bonus of $500 to each Advanced
17 International Certificate of Education teacher in a school
18 designated performance grade category "D" or "F" who has at
19 least one student scoring E 2 or higher on the full-credit
20 Advanced International Certificate of Education examination,
21 regardless of the number of classes taught or of the number of
22 students scoring a E 2 or higher on the full-credit Advanced
23 International Certificate of Education examination.
24 3. Additional bonuses of $250 each to teachers of
25 half-credit Advanced International Certificate of Education
26 classes in a school designated performance grade category "D"
27 or "F" which has at least one student scoring an E a 1 or
28 higher on the half-credit Advanced International Certificate
29 of Education examination in that class. The maximum additional
30 bonus for a teacher awarded in accordance with this
31 subparagraph shall not exceed $500 in any given school year.

1 Teachers receiving an award under subparagraph 2. are not
2 eligible for a bonus under this subparagraph.

4 Bonuses awarded to a teacher according to this paragraph shall
5 not exceed $2,000 in any given school year and shall be in
6 addition to any regular wage or other bonus the teacher
7 received or is scheduled to receive.
8 (n) Calculation of additional full-time equivalent
9 membership based on International General Certificate of
10 Secondary Education examination scores of students.--A value
11 of 0.12 full-time equivalent student membership shall be
12 calculated for each student enrolled in an International
13 General Certificate of Secondary Education (pre-AICE) course
14 who receives a score of E or higher on a subject examination.
15 A value of 0.15 full-time equivalent student membership shall
16 be calculated for each student who receives an International
17 Certificate of Education diploma. Such value shall be added to
18 the total full-time equivalent student membership in basic
19 programs for grades 9 through 12 in the subsequent fiscal
20 year.
21 Section 11. For the purpose of incorporating the
22 amendment to section 1011.62, Florida Statutes, in a reference
23 thereto, subsection (2) of section 1011.69, Florida Statutes,
24 is reenacted to read:
25 1011.69 Equity in School-Level Funding Act.--
26 (2) Beginning in the 2003-2004 fiscal year, district
27 school boards shall allocate to schools within the district an
28 average of 90 percent of the funds generated by all schools
29 and guarantee that each school receives at least 80 percent of
30 the funds generated by that school based upon the Florida
31 Education Finance Program as provided in s. 1011.62 and the

1 General Appropriations Act, including gross state and local
2 funds, discretionary lottery funds, and funds from the school
3 district's current operating discretionary millage levy. Total
4 funding for each school shall be recalculated during the year
5 to reflect the revised calculations under the Florida
6 Education Finance Program by the state and the actual weighted
7 full-time equivalent students reported by the school during
8 the full-time equivalent student survey periods designated by
9 the Commissioner of Education. If the district school board is
10 providing programs or services to students funded by federal
11 funds, any eligible students enrolled in the schools in the
12 district shall be provided federal funds. Only academic
13 performance-based charter school districts, pursuant to s.
14 1003.62, are exempt from the provisions of this section.
15 Section 12. This act shall take effect July 1, 2005.
