10 the amendment to s. 1011.62, F.S., in a
11 reference thereto; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Paragraph (a) of subsection (6) of section
16 1002.20, Florida Statutes, is amended to read:
17 1002.20 K-12 student and parent rights.--Parents of
18 public school students must receive accurate and timely
19 information regarding their child's academic progress and must
20 be informed of ways they can help their child to succeed in
21 school. K-12 students and their parents are afforded numerous
22 statutory rights including, but not limited to, the following:
23 (6) EDUCATIONAL CHOICE.--
24 (a) Public school choices.--Parents of public school
25 students may seek whatever public school choice options that
26 are applicable to their students and are available to students
27 in their school districts. These options may include
28 controlled open enrollment, lab schools, charter schools,
29 charter technical career centers, magnet schools, alternative
30 schools, special programs, advanced placement, dual
31 enrollment, International Baccalaureate, International General

1 Certificate of Secondary Education (pre-AICE), Advanced
2 International Certificate of Education, early admissions,
3 credit by examination or demonstration of competency, the New
4 World School of the Arts, the Florida School for the Deaf and
5 the Blind, and the Florida Virtual School. These options may
6 also include the public school choice options of the
7 Opportunity Scholarship Program and the McKay Scholarships for
8 Students with Disabilities Program.
9 Section 2. Paragraph (d) of subsection (2) of section
10 1002.23, Florida Statutes, is amended to read:
11 1002.23 Family and School Partnership for Student
12 Achievement Act.--
13 (2) To facilitate meaningful parent and family
14 involvement, the Department of Education shall develop
15 guidelines for a parent guide to successful student
16 achievement which describes what parents need to know about
17 their child's educational progress and how they can help their
18 child to succeed in school. The guidelines shall include, but
19 need not be limited to:
20 (d) Opportunities for parents to learn about rigorous
21 academic programs that may be available for their child, such
22 as honors programs, dual enrollment, advanced placement,
23 International Baccalaureate, International General Certificate
24 of Secondary Education (pre-AICE), Advanced International
25 Certificate of Education, Florida Virtual High School courses,
26 and accelerated access to postsecondary education;
27 Section 3. Subsection (2) of section 1007.22, Florida
28 Statutes, is amended to read:
29 1007.22 Articulation; postsecondary institution
30 coordination and collaboration.--

1 (2) The levels of postsecondary education shall
2 collaborate in further developing and providing articulated
3 programs in which students can proceed toward their
4 educational objectives as rapidly as their circumstances
5 permit. Time-shortened educational programs, as well as the
6 use of acceleration mechanisms, shall include, but not be
7 limited to, the International Baccalaureate, Advanced
8 International Certificate of Education, credit by examination
9 or demonstration of competency, advanced placement, early
10 admissions, and dual enrollment.
11 Section 4. Subsection (10) of section 1007.261,
12 Florida Statutes, is amended to read:
13 1007.261 State universities; admissions of
14 students.--Each university board of trustees is authorized to
15 adopt rules governing the admission of students, subject to
16 this section and rules of the State Board of Education.
17 (10) A Florida resident who is denied admission as an
18 undergraduate to a state university for failure to meet the
19 high school grade point average requirement may appeal the
20 decision to the university and request a recalculation of the
21 grade point average including in the revised calculation the
22 grades earned in up to three credits of advanced fine arts
23 courses. The university shall provide the student with a
24 description of the appeals process at the same time as
25 notification of the admissions decision. The university shall
26 recalculate the student's grade point average using the
27 additional courses and advise the student of any changes in
28 the student's admission status. For purposes of this section,
29 fine arts courses include courses in music, drama, painting,
30 sculpture, speech, debate, or a course in any art form that
31 requires manual dexterity. Advanced level fine arts courses

1 include fine arts courses identified in the course code
2 directory as Advanced Placement, pre-International
3 Baccalaureate, or International Baccalaureate, International
4 General Certificate of Secondary Education (pre-AICE), or
5 Advanced International Certificate of Education, or fine arts
6 courses taken in the third or fourth year of a fine arts
7 curriculum.
8 Section 5. Subsection (9) of section 1007.27, Florida
9 Statutes, is amended to read:
10 1007.27 Articulated acceleration mechanisms.--
11 (9) The Advanced International Certificate of
12 Education Program and the International General Certificate of
13 Secondary Education (pre-AICE) Program shall be the curricula
14 curriculum in which eligible secondary students are enrolled
15 in programs of study a program of studies offered through the
16 Advanced International Certificate of Education Program or the
17 International General Certificate of Secondary Education
18 (pre-AICE) Program administered by the University of Cambridge
19 Local Examinations Syndicate. The State Board of Education
20 shall establish rules which specify the cutoff scores and
21 Advanced International Certificate of Education examinations
22 which will be used to grant postsecondary credit at community
23 colleges and universities. Any such rules, which have the
24 effect of raising the required cutoff score or of changing the
25 Advanced International Certification of Education examinations
26 which will be used to grant postsecondary credit, shall apply
27 to students taking Advanced International Certificate of
28 Education Examinations after such rules are adopted by the
29 State Board of Education. Students shall be awarded a maximum
30 of 30 semester credit hours pursuant to this subsection. The
31 specific course for which a student receives such credit shall

1 be determined by the community college or university that
2 accepts the student for admission. Students enrolled in
3 either program of study pursuant to this subsection shall be
4 exempt from the payment of any fees for administration of the
5 examinations regardless of whether or not the student achieves
6 a passing score on the examination.
7 Section 6. Paragraph (a) of subsection (3) of section
8 1009.531, Florida Statutes, is amended to read:
9 1009.531 Florida Bright Futures Scholarship Program;
10 student eligibility requirements for initial awards.--
11 (3) For purposes of calculating the grade point
12 average to be used in determining initial eligibility for a
13 Florida Bright Futures Scholarship, the department shall
14 assign additional weights to grades earned in the following
15 courses:
16 (a) Courses identified in the course code directory as
17 Advanced Placement, pre-International Baccalaureate, or
18 International Baccalaureate, International General Certificate
19 of Secondary Education (pre-AICE), or Advanced International
20 Certificate of Education.

22 The department may assign additional weights to courses, other
23 than those described in paragraphs (a) and (b), that are
24 identified by the Department of Education as containing
25 rigorous academic curriculum and performance standards. The
26 additional weight assigned to a course pursuant to this
27 subsection shall not exceed 0.5 per course. The weighted
28 system shall be developed and distributed to all high schools
29 in the state prior to January 1, 1998. The department may
30 determine a student's eligibility status during the senior
31

1 year before graduation and may inform the student of the award
2 at that time.
3 Section 7. Subsection (1) of section 1009.534, Florida
4 Statutes, is amended to read:
5 1009.534 Florida Academic Scholars award.--
6 (1) A student is eligible for a Florida Academic
7 Scholars award if the student meets the general eligibility
8 requirements for the Florida Bright Futures Scholarship
9 Program and the student:
10 (a) Has achieved a 3.5 weighted grade point average as
11 calculated pursuant to s. 1009.531, or its equivalent, in high
12 school courses that are designated by the State Board of
13 Education as college-preparatory academic courses; and has
14 attained at least the score identified by rules of the State
15 Board of Education on the combined verbal and quantitative
16 parts of the Scholastic Aptitude Test, the Scholastic
17 Assessment Test, or the recentered Scholastic Assessment Test
18 of the College Entrance Examination, or an equivalent score on
19 the ACT Assessment Program; or
20 (b) Has attended a home education program according to
21 s. 1002.41 during grades 11 and 12 or has completed the
22 International Baccalaureate curriculum but failed to earn the
23 International Baccalaureate Diploma or has completed the
24 curriculum for the Advanced International Certificate of
25 Education but failed to earn the Advanced International
26 Certificate of Education Diploma, and has attained at least
27 the score identified by rules of the State Board of Education
28 on the combined verbal and quantitative parts of the
29 Scholastic Aptitude Test, the Scholastic Assessment Test, or
30 the recentered Scholastic Assessment Test of the College

1 Entrance Examination, or an equivalent score on the ACT
2 Assessment Program; or
3 (c) Has been awarded an International Baccalaureate
4 Diploma from the International Baccalaureate Office or an
5 Advanced International Certificate of Education Diploma from
6 the University of Cambridge International Examinations Office;
7 or
8 (d) Has been recognized by the merit or achievement
9 programs of the National Merit Scholarship Corporation as a
10 scholar or finalist; or
11 (e) Has been recognized by the National Hispanic
12 Recognition Program as a scholar recipient.

14 A student must complete a program of community service work,
15 as approved by the district school board or the administrators
16 of a nonpublic school, which shall include a minimum of 75
17 hours of service work and require the student to identify a
18 social problem that interests him or her, develop a plan for
19 his or her personal involvement in addressing the problem,
20 and, through papers or other presentations, evaluate and
21 reflect upon his or her experience.
22 Section 8. Subsection (1) of section 1009.535, Florida
23 Statutes, is amended to read:
24 1009.535 Florida Medallion Scholars award.--
25 (1) A student is eligible for a Florida Medallion
26 Scholars award if the student meets the general eligibility
27 requirements for the Florida Bright Futures Scholarship
28 Program and the student:
29 (a) Has achieved a weighted grade point average of 3.0
30 as calculated pursuant to s. 1009.531, or the equivalent, in
31 high school courses that are designated by the State Board of

1 Education as college-preparatory academic courses; and has
2 attained at least the score identified by rules of the State
3 Board of Education on the combined verbal and quantitative
4 parts of the Scholastic Aptitude Test, the Scholastic
5 Assessment Test, or the recentered Scholastic Assessment Test
6 of the College Entrance Examination, or an equivalent score on
7 the ACT Assessment Program; or
8 (b) Has attended a home education program according to
9 s. 1002.41 during grades 11 and 12 or has completed the
10 International Baccalaureate curriculum but failed to earn the
11 International Baccalaureate Diploma or has completed the
12 curriculum for the Advanced International Certificate of
13 Education but failed to earn the Advanced International
14 Certificate of Education Diploma, and has attained at least
15 the score identified by rules of the State Board of Education
16 on the combined verbal and quantitative parts of the
17 Scholastic Aptitude Test, the Scholastic Assessment Test, or
18 the recentered Scholastic Assessment Test of the College

21 (c) Has been recognized by the merit or achievement
22 program of the National Merit Scholarship Corporation as a
23 scholar or finalist but has not completed a program of
24 community service as provided in s. 1009.534; or
25 (d) Has been recognized by the National Hispanic
26 Recognition Program as a scholar, but has not completed a
27 program of community service as provided in s. 1009.534.
28 Section 9. Paragraph (m) of subsection (1) of section
29 1011.62, Florida Statutes, is amended, present paragraphs (n),
30 (o), (p), (q), and (r) of that subsection are redesignated as

1 paragraphs (o), (p), (q), (r), and (s), respectively, and a
2 new paragraph (n) is added to that subsection, to read:
3 1011.62 Funds for operation of schools.--If the annual
4 allocation from the Florida Education Finance Program to each
5 district for operation of schools is not determined in the
6 annual appropriations act or the substantive bill implementing
7 the annual appropriations act, it shall be determined as
8 follows:
9 (1) COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR
10 OPERATION.--The following procedure shall be followed in
11 determining the annual allocation to each district for
12 operation:
13 (m) Calculation of additional full-time equivalent
14 membership based on Advanced International Certificate of
15 Education examination scores of students.--A value of 0.24
16 full-time equivalent student membership shall be calculated
17 for each student enrolled in a full-credit Advanced
18 International Certificate of Education course who receives a
19 score of E 2 or higher on a subject examination. A value of
20 0.12 full-time equivalent student membership shall be
21 calculated for each student enrolled in a half-credit Advanced
22 International Certificate of Education course who receives a
23 score of E 1 or higher on a subject examination. A value of
24 0.3 full-time equivalent student membership shall be
25 calculated for each student who receives received an Advanced
26 International Certificate of Education diploma. Such value
27 shall be added to the total full-time equivalent student
28 membership in basic programs for grades 9 through 12 in the
29 subsequent fiscal year. The school district shall distribute
30 to each classroom teacher who provided Advanced International
31 Certificate of Education instruction:

1 1. A bonus in the amount of $50 for each student
2 taught by the Advanced International Certificate of Education
3 teacher in each full-credit Advanced International Certificate
4 of Education course who receives a score of E 2 or higher on
5 the Advanced International Certificate of Education
6 examination. A bonus in the amount of $25 for each student
7 taught by the Advanced International Certificate of Education
8 teacher in each half-credit Advanced International Certificate
9 of Education course who receives a score of E 1 or higher on
10 the Advanced International Certificate of Education
11 examination.
12 2. An additional bonus of $500 to each Advanced
13 International Certificate of Education teacher in a school
14 designated performance grade category "D" or "F" who has at
15 least one student scoring E 2 or higher on the full-credit
16 Advanced International Certificate of Education examination,
17 regardless of the number of classes taught or of the number of
18 students scoring an E a 2 or higher on the full-credit
19 Advanced International Certificate of Education examination.
20 3. Additional bonuses of $250 each to teachers of
21 half-credit Advanced International Certificate of Education
22 classes in a school designated performance grade category "D"
23 or "F" which has at least one student scoring an E a 1 or
24 higher on the half-credit Advanced International Certificate
25 of Education examination in that class. The maximum additional
26 bonus for a teacher awarded in accordance with this
27 subparagraph shall not exceed $500 in any given school year.
28 Teachers receiving an award under subparagraph 2. are not
29 eligible for a bonus under this subparagraph.

1 Bonuses awarded to a teacher according to this paragraph shall
2 not exceed $2,000 in any given school year and shall be in
3 addition to any regular wage or other bonus the teacher
4 received or is scheduled to receive.
5 (n) Calculation of additional full-time equivalent
6 membership based on International General Certificate of
7 Secondary Education examination scores of students.--A value
8 of 0.12 full-time equivalent student membership shall be
9 calculated for each student enrolled in an International
10 General Certificate of Secondary Education (pre-AICE) course
11 who receives a score of E or higher on a subject examination.
12 A value of 0.15 full-time equivalent student membership shall
13 be calculated for each student who receives an International
14 Certificate of Education diploma. Such value shall be added to
15 the total full-time equivalent student membership in basic
16 programs for grades 9 through 12 in the subsequent fiscal
17 year.
18 Section 10. For the purpose of incorporating the
19 amendment to section 1011.62, Florida Statutes, in a reference
20 thereto, subsection (2) of section 1011.69, Florida Statutes,
21 is reenacted to read:
22 1011.69 Equity in School-Level Funding Act.--
23 (2) Beginning in the 2003-2004 fiscal year, district
24 school boards shall allocate to schools within the district an
25 average of 90 percent of the funds generated by all schools
26 and guarantee that each school receives at least 80 percent of
27 the funds generated by that school based upon the Florida
28 Education Finance Program as provided in s. 1011.62 and the
29 General Appropriations Act, including gross state and local
30 funds, discretionary lottery funds, and funds from the school
31 district's current operating discretionary millage levy. Total

1 funding for each school shall be recalculated during the year
2 to reflect the revised calculations under the Florida
3 Education Finance Program by the state and the actual weighted
4 full-time equivalent students reported by the school during
5 the full-time equivalent student survey periods designated by
6 the Commissioner of Education. If the district school board is
7 providing programs or services to students funded by federal
8 funds, any eligible students enrolled in the schools in the
9 district shall be provided federal funds. Only academic
10 performance-based charter school districts, pursuant to s.
11 1003.62, are exempt from the provisions of this section.
12 Section 11. This act shall take effect July 1, 2005.
