23 Be It Enacted by the Legislature of the State of Florida:
24
25 Section 1. Paragraph (a) of subsection (6) of section
26 1002.20, Florida Statutes, is amended to read:
27 1002.20 K-12 student and parent rights.--Parents of
28 public school students must receive accurate and timely
29 information regarding their child's academic progress and must
30 be informed of ways they can help their child to succeed in
31

1 school. K-12 students and their parents are afforded numerous
2 statutory rights including, but not limited to, the following:
3 (6) EDUCATIONAL CHOICE.--
4 (a) Public school choices.--Parents of public school
5 students may seek whatever public school choice options that
6 are applicable to their students and are available to students
7 in their school districts. These options may include
8 controlled open enrollment, lab schools, charter schools,
9 charter technical career centers, magnet schools, alternative
10 schools, special programs, advanced placement, dual
11 enrollment, International Baccalaureate, International General
12 Certificate of Secondary Education (pre-AICE), Advanced
13 International Certificate of Education, early admissions,
14 credit by examination or demonstration of competency, the New
15 World School of the Arts, the Florida School for the Deaf and
16 the Blind, and the Florida Virtual School. These options may
17 also include the public school choice options of the
18 Opportunity Scholarship Program and the McKay Scholarships for
19 Students with Disabilities Program.
20 Section 2. Subsection (2) of section 1002.23, Florida
21 Statutes, is amended to read:
22 1002.23 Family and School Partnership for Student
23 Achievement Act.--
24 (2) To facilitate meaningful parent and family
25 involvement, the Department of Education shall develop
26 guidelines for a parent guide to successful student
27 achievement which describes what parents need to know about
28 their child's educational progress and how they can help their
29 child to succeed in school. The guidelines shall include, but
30 need not be limited to:
31 (a) Parental information regarding:

1 1. Requirements for their child to be promoted to the
2 next grade, as provided for in s. 1008.25;
3 2. Progress of their child toward achieving state and
4 district expectations for academic proficiency;
5 3. Assessment results, including report cards and
6 progress reports; and
7 4. Qualifications of their child's teachers;
8 (b) Services available for parents and their children,
9 such as family literacy services; mentoring, tutorial, and
10 other academic reinforcement programs; college planning,
11 academic advisement, and student counseling services; and
12 after-school programs;
13 (c) Opportunities for parental participation, such as
14 parenting classes, adult education, school advisory councils,
15 and school volunteer programs;
16 (d) Opportunities for parents to learn about rigorous
17 academic programs that may be available for their child, such
18 as honors programs, dual enrollment, advanced placement,
19 International Baccalaureate, International General Certificate
20 of Secondary Education (pre-AICE), Advanced International
21 Certificate of Education, Florida Virtual High School courses,
22 and accelerated access to postsecondary education;
23 (e) Educational choices, as provided for in s.
24 1002.20(6), and corporate income tax credit scholarships, as
25 provided for in s. 220.187;
26 (f) Classroom and test accommodations available for
27 students with disabilities; and
28 (g) School board rules, policies, and procedures for
29 student promotion and retention, academic standards, student
30 assessment, courses of study, instructional materials, and
31 contact information for school and district offices.

1 Section 3. Subsection (2) of section 1007.22, Florida
2 Statutes, is amended to read:
3 1007.22 Articulation; postsecondary institution
4 coordination and collaboration.--
5 (2) The levels of postsecondary education shall
6 collaborate in further developing and providing articulated
7 programs in which students can proceed toward their
8 educational objectives as rapidly as their circumstances
9 permit. Time-shortened educational programs, as well as the
10 use of acceleration mechanisms, shall include, but not be
11 limited to, the International Baccalaureate, Advanced
12 International Certificate of Education, credit by examination
13 or demonstration of competency, advanced placement, early
14 admissions, and dual enrollment.
15 Section 4. Subsection (10) of section 1007.261,
16 Florida Statutes, is amended to read:
17 1007.261 State universities; admissions of
18 students.--Each university board of trustees is authorized to
19 adopt rules governing the admission of students, subject to
20 this section and rules of the State Board of Education.
21 (10) A Florida resident who is denied admission as an
22 undergraduate to a state university for failure to meet the
23 high school grade point average requirement may appeal the
24 decision to the university and request a recalculation of the
25 grade point average including in the revised calculation the
26 grades earned in up to three credits of advanced fine arts
27 courses. The university shall provide the student with a
28 description of the appeals process at the same time as
29 notification of the admissions decision. The university shall
30 recalculate the student's grade point average using the
31 additional courses and advise the student of any changes in

1 the student's admission status. For purposes of this section,
2 fine arts courses include courses in music, drama, painting,
3 sculpture, speech, debate, or a course in any art form that
4 requires manual dexterity. Advanced level fine arts courses
5 include fine arts courses identified in the course code
6 directory as Advanced Placement, pre-International
7 Baccalaureate, or International Baccalaureate, International
8 General Certificate of Secondary Education (pre-AICE),
9 Advanced International Certificate of Education, or fine arts
10 courses taken in the third or fourth year of a fine arts
11 curriculum.
12 Section 5. Subsection (9) of section 1007.27, Florida
13 Statutes, is amended to read:
14 1007.27 Articulated acceleration mechanisms.--
15 (9) The Advanced International Certificate of
16 Education Program and the International General Certificate of
17 Secondary Education (pre-AICE) Program shall be the curricula
18 curriculum in which eligible secondary students are enrolled
19 in programs of study a program of studies offered through the
20 Advanced International Certificate of Education Program or the
21 International General Certificate of Secondary Education
22 (pre-AICE) Program administered by the University of Cambridge
23 Local Examinations Syndicate. The State Board of Education
24 shall establish rules which specify the cutoff scores and
25 Advanced International Certificate of Education examinations
26 which will be used to grant postsecondary credit at community
27 colleges and universities. Any such rules, which have the
28 effect of raising the required cutoff score or of changing the
29 Advanced International Certification of Education examinations
30 which will be used to grant postsecondary credit, shall apply
31 to students taking Advanced International Certificate of

1 Education Examinations after such rules are adopted by the
2 State Board of Education. Students shall be awarded a maximum
3 of 30 semester credit hours pursuant to this subsection. The
4 specific course for which a student receives such credit shall
5 be determined by the community college or university that
6 accepts the student for admission. Students enrolled in
7 either program of study pursuant to this subsection shall be
8 exempt from the payment of any fees for administration of the
9 examinations regardless of whether or not the student achieves
10 a passing score on the examination.
11 Section 6. Subsections (1), (2), (4), (5), (6), (11),
12 and (13) of section 1007.271, Florida Statutes, are amended to
13 read:
14 1007.271 Dual enrollment programs.--
15 (1) The dual enrollment program is the enrollment of
16 an eligible secondary student or home education student in a
17 postsecondary course creditable toward high school graduation
18 and a career certificate or an associate or baccalaureate
19 degree.
20 (2) For the purpose of this section, an eligible
21 secondary student is a student who is enrolled in a Florida
22 public secondary school or in a Florida private secondary
23 school which is in compliance with s. 1002.42(2) and conducts
24 a secondary curriculum pursuant to s. 1003.43. Students
25 enrolled in postsecondary instruction that is not creditable
26 toward the high school diploma shall not be classified as dual
27 enrollments. Students who are eligible for dual enrollment
28 pursuant to this section shall be permitted to enroll in dual
29 enrollment courses conducted during school hours, after school
30 hours, and during the summer term. Instructional time for such
31 enrollment may vary from exceed 900 hours; however, the school

1 district may only report the student for a maximum of 1.0 FTE,
2 as provided in s. 1011.61(4). Each semester of instruction
3 that generates high school and postsecondary credit shall be
4 reported by each school district as 75 membership hours for
5 purposes of FTE calculation. Any student so enrolled is exempt
6 from the payment of registration, tuition, and laboratory
7 fees. Vocational-preparatory instruction, college-preparatory
8 instruction and other forms of precollegiate instruction, as
9 well as physical education courses that focus on the physical
10 execution of a skill rather than the intellectual attributes
11 of the activity, are ineligible for inclusion in the dual
12 enrollment program. Recreation and leisure studies courses
13 shall be evaluated individually in the same manner as physical
14 education courses for potential inclusion in the program.
15 (4) Career dual enrollment shall be provided as a
16 curricular option for secondary students to pursue in order to
17 earn a series of elective credits toward the high school
18 diploma. However, career dual enrollment shall not supplant
19 student acquisition of the diploma. Career dual enrollment
20 shall be available for secondary students seeking a degree or
21 certificate from a complete career-preparatory program, and
22 may not be used to enroll students but shall not sustain
23 student enrollment in isolated career courses. It is the
24 intent of the Legislature that career dual enrollment provide
25 reflect the interests and aptitudes of the student. The
26 provision of a comprehensive academic and career dual
27 enrollment program within the career center or community
28 college is supportive of legislative intent; however, such
29 provision is not mandatory.
30 (5) Each district school board shall inform all
31 secondary students of dual enrollment as an educational option

1 and mechanism for acceleration. Students shall be informed of
2 eligibility criteria, the option for taking dual enrollment
3 courses beyond the regular school year, and the 24 minimum
4 academic credits required for graduation. District school
5 boards shall annually assess the demand for dual enrollment
6 and other advanced courses, and the district school board
7 shall consider strategies and programs to meet that demand.
8 (6) The Commissioner of Education shall appoint
9 faculty committees representing public school, community
10 college, and university faculties to identify postsecondary
11 courses that meet the high school graduation requirements of
12 s. 1003.43, and to establish the number of postsecondary
13 semester credit hours of instruction and equivalent high
14 school credits earned through dual enrollment pursuant to this
15 section that are necessary to meet high school graduation
16 requirements. Such equivalencies shall be determined solely on
17 comparable course content and not on seat time traditionally
18 allocated to such courses in high school. The Commissioner of
19 Education shall recommend to the State Board of Education
20 those post secondary courses identified to meet high school
21 graduation requirements, based on mastery of course outcomes,
22 by their statewide course number, and all high schools shall
23 accept these postsecondary education courses toward meeting
24 the requirements of s. 1003.43.
25 (11) The Department of Education shall approve any
26 course for inclusion in the dual enrollment program that is
27 contained within the statewide course numbering system.
28 However, college-preparatory and other forms of precollegiate
29 instruction, and physical education and other courses that
30 focus on the physical execution of a skill rather than the
31 intellectual attributes of the activity, may not be so

1 approved, but must be evaluated individually for potential
2 inclusion in the dual enrollment program. This subsection does
3 not mean that an independent postsecondary institution
4 eligible for inclusion in a dual enrollment or early admission
5 program pursuant to s. 1011.62 must participate in the
6 statewide course numbering system developed pursuant to s.
7 1007.24 to participate in a dual enrollment program.
8 (13) It is the intent of the Legislature that Students
9 who meet the eligibility requirements of this section
10 subsection and who choose to participate in dual enrollment
11 programs are be exempt from the payment of registration,
12 tuition, and laboratory fees.
13 Section 7. Subsection (3) of section 1009.531, Florida
14 Statutes, is amended to read:
15 1009.531 Florida Bright Futures Scholarship Program;
16 student eligibility requirements for initial awards.--
17 (3) For purposes of calculating the grade point
18 average to be used in determining initial eligibility for a
19 Florida Bright Futures Scholarship, the department shall
20 assign additional weights to grades earned in the following
21 courses:
22 (a) Courses identified in the course code directory as
23 Advanced Placement, pre-International Baccalaureate, or
24 International Baccalaureate, International General Certificate
25 of Secondary Education (pre-AICE), or Advanced International
26 Certificate of Education.
27 (b) Courses designated as academic dual enrollment
28 courses in the statewide course numbering system.

30 The department may assign additional weights to courses, other
31 than those described in paragraphs (a) and (b), that are

1 identified by the Department of Education as containing
2 rigorous academic curriculum and performance standards. The
3 additional weight assigned to a course pursuant to this
4 subsection shall not exceed 0.5 per course. The weighted
5 system shall be developed and distributed to all high schools
6 in the state prior to January 1, 1998. The department may
7 determine a student's eligibility status during the senior
8 year before graduation and may inform the student of the award
9 at that time.
10 Section 8. Subsection (1) of section 1009.534, Florida
11 Statutes, is amended to read:
12 1009.534 Florida Academic Scholars award.--
13 (1) A student is eligible for a Florida Academic
14 Scholars award if the student meets the general eligibility
15 requirements for the Florida Bright Futures Scholarship
16 Program and the student:
17 (a) Has achieved a 3.5 weighted grade point average as
18 calculated pursuant to s. 1009.531, or its equivalent, in high
19 school courses that are designated by the State Board of
20 Education as college-preparatory academic courses; and has
21 attained at least the score identified by rules of the State
22 Board of Education on the combined verbal and quantitative
23 parts of the Scholastic Aptitude Test, the Scholastic
24 Assessment Test, or the recentered Scholastic Assessment Test
25 of the College Entrance Examination, or an equivalent score on
26 the ACT Assessment Program; or
27 (b) Has attended a home education program according to
28 s. 1002.41 during grades 11 and 12 or has completed the
29 International Baccalaureate curriculum but failed to earn the
30 International Baccalaureate Diploma or has completed the
31 Advanced International Certificate of Education curriculum but

1 failed to earn the Advanced International Certificate of
2 Education Diploma, and has attained at least the score
3 identified by rules of the State Board of Education on the
4 combined verbal and quantitative parts of the Scholastic
5 Aptitude Test, the Scholastic Assessment Test, or the
6 recentered Scholastic Assessment Test of the College Entrance
7 Examination, or an equivalent score on the ACT Assessment
8 Program; or
9 (c) Has been awarded an International Baccalaureate
10 Diploma from the International Baccalaureate Office or an
11 Advanced International Certificate of Education Diploma from
12 the University of Cambridge International Examinations Office;
13 or
14 (d) Has been recognized by the merit or achievement
15 programs of the National Merit Scholarship Corporation as a
16 scholar or finalist; or
17 (e) Has been recognized by the National Hispanic
18 Recognition Program as a scholar recipient.

20 A student must complete a program of community service work,
21 as approved by the district school board or the administrators
22 of a nonpublic school, which shall include a minimum of 75
23 hours of service work and require the student to identify a
24 social problem that interests him or her, develop a plan for
25 his or her personal involvement in addressing the problem,
26 and, through papers or other presentations, evaluate and
27 reflect upon his or her experience.
28 Section 9. Subsection (1) of section 1009.535, Florida
29 Statutes, is amended to read:
30 1009.535 Florida Medallion Scholars award.--

1 (1) A student is eligible for a Florida Medallion
2 Scholars award if the student meets the general eligibility
3 requirements for the Florida Bright Futures Scholarship
4 Program and the student:
5 (a) Has achieved a weighted grade point average of 3.0
6 as calculated pursuant to s. 1009.531, or the equivalent, in
7 high school courses that are designated by the State Board of
8 Education as college-preparatory academic courses; and has
9 attained at least the score identified by rules of the State
10 Board of Education on the combined verbal and quantitative
11 parts of the Scholastic Aptitude Test, the Scholastic
12 Assessment Test, or the recentered Scholastic Assessment Test
13 of the College Entrance Examination, or an equivalent score on
14 the ACT Assessment Program; or
15 (b) Has attended a home education program according to
16 s. 1002.41 during grades 11 and 12 or has completed the
17 International Baccalaureate curriculum but failed to earn the
18 International Baccalaureate Diploma or has completed the
19 Advanced International Certificate of Education curriculum but
20 failed to earn the Advanced International Certificate of
21 Education Diploma, and has attained at least the score
22 identified by rules of the State Board of Education on the
23 combined verbal and quantitative parts of the Scholastic
24 Aptitude Test, the Scholastic Assessment Test, or the
25 recentered Scholastic Assessment Test of the College Entrance
26 Examination, or an equivalent score on the ACT Assessment
27 Program; or
28 (c) Has been recognized by the merit or achievement
29 program of the National Merit Scholarship Corporation as a
30 scholar or finalist but has not completed a program of
31 community service as provided in s. 1009.534; or

1 (d) Has been recognized by the National Hispanic
2 Recognition Program as a scholar, but has not completed a
3 program of community service as provided in s. 1009.534.
4 Section 10. Paragraphs (i) and (m) of subsection (1)
5 of section 1011.62, Florida Statutes, are amended and
6 paragraphs (n), (o), (p), (q), and (r) are redesignated as
7 paragraphs (o), (p), (q), (r), and (s), respectively, and a
8 new paragraph (n) is added to that subsection, to read:
9 1011.62 Funds for operation of schools.--If the annual
10 allocation from the Florida Education Finance Program to each
11 district for operation of schools is not determined in the
12 annual appropriations act or the substantive bill implementing
13 the annual appropriations act, it shall be determined as
14 follows:
15 (1) COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR
16 OPERATION.--The following procedure shall be followed in
17 determining the annual allocation to each district for
18 operation:
19 (i) Calculation of full-time equivalent membership
20 with respect to dual enrollment instruction from community
21 colleges or state universities.--Students enrolled in
22 community college or university dual enrollment instruction
23 pursuant to s. 1007.271 may be included in calculations of
24 full-time equivalent student memberships for basic programs
25 for grades 9 through 12 by a district school board. Each
26 semester of instruction that generates high school and
27 postsecondary credit shall be reported by each school district
28 as 75 membership hours for purposes of FTE calculation. Such
29 students may also be calculated as the proportional shares of
30 full-time equivalent enrollments they generate for a the
31 community college or university conducting the dual enrollment

1 instruction. Early admission students shall be considered dual
2 enrollments for funding purposes. Students may be enrolled in
3 dual enrollment instruction provided by an eligible
4 independent college or university and may be included in
5 calculations of full-time equivalent student memberships for
6 basic programs for grades 9 through 12 by a district school
7 board. However, those provisions of law which exempt dual
8 enrolled and early admission students from payment of
9 instructional materials and tuition and fees, including
10 laboratory fees, shall not apply to students who select the
11 option of enrolling in an eligible independent institution. An
12 independent college or university which is located and
13 chartered in Florida, is not for profit, is accredited by the
14 Commission on Colleges of the Southern Association of Colleges
15 and Schools or the Accrediting Council for Independent
16 Colleges and Schools, and which confers degrees as defined in
17 s. 1005.02 shall be eligible for inclusion in the dual
18 enrollment or early admission program. Students enrolled in
19 dual enrollment instruction shall be exempt from the payment
20 of tuition and fees, including laboratory fees. No student
21 enrolled in college credit mathematics or English dual
22 enrollment instruction shall be funded as a dual enrollment
23 unless the student has successfully completed the relevant
24 section of the entry-level examination required pursuant to s.
25 1008.30.
26 (m) Calculation of additional full-time equivalent
27 membership based on Advanced International Certificate of
28 Education examination scores of students.--A value of 0.24
29 full-time equivalent student membership shall be calculated
30 for each student enrolled in a full-credit Advanced
31 International Certificate of Education course who receives a

1 score of E 2 or higher on a subject examination. A value of
2 0.12 full-time equivalent student membership shall be
3 calculated for each student enrolled in a half-credit Advanced
4 International Certificate of Education course who receives a
5 score of E 1 or higher on a subject examination. A value of
6 0.3 full-time equivalent student membership shall be
7 calculated for each student who receives received an Advanced
8 International Certificate of Education diploma. Such value
9 shall be added to the total full-time equivalent student
10 membership in basic programs for grades 9 through 12 in the
11 subsequent fiscal year. The school district shall distribute
12 to each classroom teacher who provided Advanced International
13 Certificate of Education instruction:
14 1. A bonus in the amount of $50 for each student
15 taught by the Advanced International Certificate of Education
16 teacher in each full-credit Advanced International Certificate
17 of Education course who receives a score of E 2 or higher on
18 the Advanced International Certificate of Education
19 examination. A bonus in the amount of $25 for each student
20 taught by the Advanced International Certificate of Education
21 teacher in each half-credit Advanced International Certificate
22 of Education course who receives a score of E 1 or higher on
23 the Advanced International Certificate of Education
24 examination.
25 2. An additional bonus of $500 to each Advanced
26 International Certificate of Education teacher in a school
27 designated performance grade category "D" or "F" who has at
28 least one student scoring E 2 or higher on the full-credit
29 Advanced International Certificate of Education examination,
30 regardless of the number of classes taught or of the number of

1 students scoring a E 2 or higher on the full-credit Advanced
2 International Certificate of Education examination.
3 3. Additional bonuses of $250 each to teachers of
4 half-credit Advanced International Certificate of Education
5 classes in a school designated performance grade category "D"
6 or "F" which has at least one student scoring an E a 1 or

8 of Education examination in that class. The maximum additional
9 bonus for a teacher awarded in accordance with this
10 subparagraph shall not exceed $500 in any given school year.
11 Teachers receiving an award under subparagraph 2. are not
12 eligible for a bonus under this subparagraph.

14 Bonuses awarded to a teacher according to this paragraph shall
15 not exceed $2,000 in any given school year and shall be in
16 addition to any regular wage or other bonus the teacher
17 received or is scheduled to receive.
18 (n) Calculation of additional full-time equivalent
19 membership based on International General Certificate of
20 Secondary Education examination scores of students.--A value
21 of 0.12 full-time equivalent student membership shall be
22 calculated for each student enrolled in an International
23 General Certificate of Secondary Education (pre-AICE) course
24 who receives a score of E or higher on a subject examination,
25 subject to available funding. A value of 0.15 full-time
26 equivalent student membership shall be calculated for each
27 student who receives an International Certificate of Education
28 diploma. Such value shall be added to the total full-time
29 equivalent student membership in basic programs for grades 9
30 through 12 in the subsequent fiscal year.

1 Section 11. For the purpose of incorporating the
2 amendment to section 1011.62, Florida Statutes, in a reference
3 thereto, subsection (2) of section 1011.69, Florida Statutes,
4 is reenacted to read:
5 1011.69 Equity in School-Level Funding Act.--
6 (2) Beginning in the 2003-2004 fiscal year, district
7 school boards shall allocate to schools within the district an
8 average of 90 percent of the funds generated by all schools
9 and guarantee that each school receives at least 80 percent of
10 the funds generated by that school based upon the Florida
11 Education Finance Program as provided in s. 1011.62 and the
12 General Appropriations Act, including gross state and local
13 funds, discretionary lottery funds, and funds from the school
14 district's current operating discretionary millage levy. Total
15 funding for each school shall be recalculated during the year
16 to reflect the revised calculations under the Florida
17 Education Finance Program by the state and the actual weighted
18 full-time equivalent students reported by the school during
19 the full-time equivalent student survey periods designated by
20 the Commissioner of Education. If the district school board is
21 providing programs or services to students funded by federal
22 funds, any eligible students enrolled in the schools in the
23 district shall be provided federal funds. Only academic
24 performance-based charter school districts, pursuant to s.
25 1003.62, are exempt from the provisions of this section.
26 Section 12. This act shall take effect July 1, 2005.

eligible for inclusion in a dual enrollment program or
10 early admission program does not have to participate in
the statewide course numbering system in order to
11 participate in dual enrollment;
12 Provides that additional FTE funding for students receiving a
certain score on the pre-AICE program is subject to
13 available funds.
