1 A bill to be entitled
2 An act relating to persons responsible for a
3 child's welfare; amending s. 39.01, F.S.;
4 redefining the term "other person responsible
5 for a child's welfare" for purposes of ch. 39,
6 F.S., to include a volunteer at a public or
7 private school, religious organization, or
8 health care provider; amending s. 827.01, F.S.;
9 redefining the term "caregiver" for purposes of
10 ch. 827, F.S., relating to laws prohibiting the
11 criminal abuse of children, to include any
12 other person responsible for a child's welfare;
13 providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Subsection (47) of section 39.01, Florida
18 Statutes, is amended to read:
19 39.01 Definitions.--When used in this chapter, unless
20 the context otherwise requires:
21 (47) "Other person responsible for a child's welfare"
22 includes the child's legal guardian, legal custodian, or
23 foster parent; an employee or volunteer of a public or private
24 school, religious organization, public or private child day
25 care center, health care provider, residential home,
26 institution, facility, or agency; or any other person legally
27 responsible for the child's welfare in a residential setting;
28 and also includes an adult sitter or relative entrusted with a
29 child's care. For the purpose of departmental investigative
30 jurisdiction, this definition does not include law enforcement
31 officers, or employees of municipal or county detention

1 facilities or the Department of Corrections, while acting in
2 an official capacity.
3 Section 2. Subsection (1) of section 827.01, Florida
4 Statutes, is amended to read:
5 827.01 Definitions.--As used in this chapter:
6 (1) "Caregiver" means a parent, adult household
7 member, or other person responsible for a child's welfare as
8 defined in s. 39.01(47).
9 Section 3. This act shall take effect July 1, 2005.

12 SENATE SUMMARY
13 Revises the definition of the term "other person
responsible for a child's welfare" to include a volunteer
14 at a public or private school, religious organization, or
health care provider. Provides a cross-reference to
15 include that definition within provisions prohibiting
child abuse.
