  1                      A bill to be entitled

  2         An act relating to the Big Cypress Area of

  3         Critical State Concern; amending s. 380.055,

  4         F.S.; excluding the Plantation Island

  5         Subdivision in Collier County from the

  6         designated area; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Subsection (3) of section 380.055, Florida

11  Statutes, is amended to read:

12         380.055  Big Cypress Area.--

13         (3)  DESIGNATION AS AREA OF CRITICAL STATE

14  CONCERN.--The "Big Cypress Area," as defined in this

15  subsection, is hereby designated as an area of critical state

16  concern.  "Big Cypress Area" means the area generally depicted

17  on the map entitled "Boundary Map, Big Cypress National

18  Freshwater Reserve, Florida," numbered BC-91,001 and dated

19  November 1971, which is on file and available for public

20  inspection in the office of the National Park Service,

21  Department of the Interior, Washington, D.C., and in the

22  office of the Board of Trustees of the Internal Improvement

23  Trust Fund, which is the area proposed as the Federal Big

24  Cypress National Freshwater Reserve, Florida, and that area

25  described as follows: Sections 1, 2, 11, 12 and 13 in Township

26  49 South, Range 31 East; and Township 49 South, Range 32 East,

27  less Sections 19, 30 and 31; and Township 49 South, Range 33

28  East; and Township 49 South, Range 34 East; and Sections 1

29  through 5 and 10 through 14 in Township 50 South, Range 32

30  East; and Sections 1 through 18 and 20 through 25 in Township

31  50 South, Range 33 East; and Township 50 South, Range 34 East,

 1  less Section 31; and Sections 1 and 2 in Township 51 South,

 2  Range 34 East; All in Collier County, Florida, which described

 3  area shall be known as the "Big Cypress National Preserve

 4  Addition, Florida," together with such contiguous land and

 5  water areas as are ecologically linked with the Everglades

 6  National Park, certain of the estuarine fisheries of South

 7  Florida, or the freshwater aquifer of South Florida, less and

 8  except that area known as Plantation Island Subdivision

 9  (unrecorded) located in Sections 13 and 24, Township 53 South,

10  Range 29 East, Collier County, Florida, the definitive

11  boundaries of which shall be set in the following manner:

12  Within 120 days following the effective date of this act, the

13  state land planning agency shall recommend definitive

14  boundaries for the Big Cypress Area to the Administration

15  Commission, after giving notice to all local governments and

16  regional planning agencies which include within their

17  boundaries any part of the area proposed to be included in the

18  Big Cypress Area and holding such hearings as the state land

19  planning agency deems appropriate.  Within 45 days following

20  receipt of the recommended boundaries, the Administration

21  Commission shall adopt, modify, or reject the recommendation

22  and shall by rule establish the boundaries of the area defined

23  as the Big Cypress Area.

24         Section 2.  This act shall take effect upon becoming a

25  law.
