A bill to be entitled
2An act relating to the Scripps Florida Funding
3Corporation; amending s. 288.955, F.S.; providing that the
4board of directors of the corporation shall have the
5exclusive right to select a provider or providers of water
6and wastewater facilities for the biomedical research
7institution and campus to be established by The Scripps
8Research Institute; specifying considerations with respect
9to the selection of a service provider by the board;
10repealing section 4, ch. 2003-420, Laws of Florida,
11relating to the authority of the county in which a
12facility established under s. 288.955, F.S., is located to
13provide water and wastewater services; providing an
14effective date.

16Be It Enacted by the Legislature of the State of Florida:
17
18     Section 1.  Subsection (6) of section 288.955, Florida
19Statutes, is amended to read:
20     288.955  Scripps Florida Funding Corporation.--
21     (6)  POWERS AND DUTIES.--
22     (a)  The corporation is organized to receive, hold, invest,
23administer, and disburse funds appropriated by the Legislature
24in support of this section and to disburse any income generated
25from the investment of these funds consistent with the purpose
26and provisions of this section. In addition to the powers and
27duties prescribed in chapter 617 and the articles and bylaws
28adopted under that chapter, the corporation:
29     1.(a)  May make and enter into contracts and assume any
30other functions that are necessary to carry out the provisions
31of this section.
32     2.(b)  May enter into leases and contracts for the purchase
33of real property and hold notes, mortgages, guarantees, or
34security agreements to secure the performance of obligations of
35the grantee under the contract.
36     3.(c)  May perform all acts and things necessary or
37convenient to carry out the powers expressly granted in this
38section and a contract entered into between the corporation and
39the grantee.
40     4.(d)  May make expenditures, from funds provided by this
41state, including any necessary administrative expenditures
42consistent with its powers.
43     5.(e)  May indemnify, and purchase and maintain insurance
44on behalf of, directors, officers, and employees of the
45corporation against any personal liability or accountability.
46     6.(f)  Shall disburse funds pursuant to the provisions of
47this section and a contract entered into between the corporation
48and the grantee.
49     7.(g)  Shall receive and review reports and financial
50documentation provided by the grantee to ensure compliance with
51the provisions of this section and provisions of the contract.
52     8.(h)  Shall prepare an annual report as prescribed in
53subsection (14).
54     (b)  Notwithstanding any other law to the contrary, the
55board of directors shall have the exclusive right to select a
56provider or providers of water and wastewater facilities for the
57biomedical research institution and campus. All public agencies
58in the county with legislative authority to provide service
59shall be invited to submit service proposals. In its selection
60of a service provider or providers the board shall consider the
61cost of the utility service, current availability of existing
62facilities, capital costs to a utility provider to extend such
63service to the institution and campus, and such other factors it
64deems relevant.
65     Section 2.  Section 4 of chapter 2003-420, Laws of Florida,
66is repealed.
67     Section 3.  This act shall take effect upon becoming a law.
