| 2 | An act relating to the Scripps Florida Funding |
| 3 | Corporation; amending s. 288.955, F.S.; providing that the |
| 4 | board of directors of the corporation shall have the |
| 5 | exclusive right to select a provider or providers of water |
| 6 | and wastewater facilities for the biomedical research |
| 7 | institution and campus to be established by The Scripps |
| 8 | Research Institute; specifying considerations with respect |
| 9 | to the selection of a service provider by the board; |
| 10 | repealing section 4, ch. 2003-420, Laws of Florida, |
| 11 | relating to the authority of the county in which a |
| 12 | facility established under s. 288.955, F.S., is located to |
| 13 | provide water and wastewater services; providing an |
| 14 | effective date. |

| 16 | Be It Enacted by the Legislature of the State of Florida: |
| 17 |
|
| 18 | Section 1. Subsection (6) of section 288.955, Florida |
| 19 | Statutes, is amended to read: |
| 20 | 288.955 Scripps Florida Funding Corporation.-- |
| 21 | (6) POWERS AND DUTIES.-- |
| 22 | (a) The corporation is organized to receive, hold, invest, |
| 23 | administer, and disburse funds appropriated by the Legislature |
| 24 | in support of this section and to disburse any income generated |
| 25 | from the investment of these funds consistent with the purpose |
| 26 | and provisions of this section. In addition to the powers and |
| 27 | duties prescribed in chapter 617 and the articles and bylaws |
| 28 | adopted under that chapter, the corporation: |
| 29 | 1.(a) May make and enter into contracts and assume any |
| 30 | other functions that are necessary to carry out the provisions |
| 31 | of this section. |
| 32 | 2.(b) May enter into leases and contracts for the purchase |
| 33 | of real property and hold notes, mortgages, guarantees, or |
| 34 | security agreements to secure the performance of obligations of |
| 35 | the grantee under the contract. |
| 36 | 3.(c) May perform all acts and things necessary or |
| 37 | convenient to carry out the powers expressly granted in this |
| 38 | section and a contract entered into between the corporation and |
| 39 | the grantee. |
| 40 | 4.(d) May make expenditures, from funds provided by this |
| 41 | state, including any necessary administrative expenditures |
| 42 | consistent with its powers. |
| 43 | 5.(e) May indemnify, and purchase and maintain insurance |
| 44 | on behalf of, directors, officers, and employees of the |
| 45 | corporation against any personal liability or accountability. |
| 46 | 6.(f) Shall disburse funds pursuant to the provisions of |
| 47 | this section and a contract entered into between the corporation |
| 48 | and the grantee. |
| 49 | 7.(g) Shall receive and review reports and financial |
| 50 | documentation provided by the grantee to ensure compliance with |
| 51 | the provisions of this section and provisions of the contract. |
| 52 | 8.(h) Shall prepare an annual report as prescribed in |
| 53 | subsection (14). |
| 54 | (b) Notwithstanding any other law to the contrary, the |
| 55 | board of directors shall have the exclusive right to select a |
| 56 | provider or providers of water and wastewater facilities for the |
| 57 | biomedical research institution and campus. All public agencies |
| 58 | in the county with legislative authority to provide service |
| 59 | shall be invited to submit service proposals. In its selection |
| 60 | of a service provider or providers the board shall consider the |
| 61 | cost of the utility service, current availability of existing |
| 62 | facilities, capital costs to a utility provider to extend such |
| 63 | service to the institution and campus, and such other factors it |
| 64 | deems relevant. |
| 65 | Section 2. Section 4 of chapter 2003-420, Laws of Florida, |
| 66 | is repealed. |
| 67 | Section 3. This act shall take effect upon becoming a law. |
