8An act relating to the Scripps Florida Funding
9Corporation; amending section 4 of ch. 2003-420, Laws of
10Florida; prohibiting the use of eminent domain or other
11applicable law to acquire the property of another
12governmental entity in order to provide water and
13wastewater service to the biomedical research facility to
14be established by the Scripps Research Institute;
15providing an effective date.

17Be It Enacted by the Legislature of the State of Florida:

19     Section 1.  Section 4 of chapter 2003-420, Laws of Florida,
20is amended to read:
21     Section 2.  Notwithstanding any other provision of law, the
22county in which the projects that are part of or ancillary to
23the state-of-the-art biomedical research institution and campus
24to be established in this state by the grantee under section
25288.955, Florida Statutes, are to be located shall have the
26exclusive right, which right may be assigned in whole or in part
27by the governing body of the county in its sole discretion, to
28provide water and wastewater services to such projects to the
29extent deemed necessary by the governing body of the county. The
30county may plan, acquire, construct, reconstruct, enlarge or
31extend, operate, and maintain water and wastewater systems and
32facilities within or without the boundaries of such projects for
33the provision of water and wastewater services. Provided, the
34local government or utility service provider shall not be
35authorized to use the provisions of chapter 73 or chapter 74,
36Florida Statutes, or any other applicable law, to acquire by
37eminent domain the property of any other governmental entity in
38order to provide water and wastewater service to the biomedical
39research facility authorized pursuant to s. 288.955, Florida
40Statutes.
41     Section 3.  This act shall take effect upon becoming a law.
