7An act relating to the Scripps Florida Funding
8Corporation; amending section 4 of ch. 2003-420, Laws of
9Florida; revising provisions with respect to the right to
10provide water and wastewater service to projects that are
11part of or ancillary to the biomedical research
12institution and campus to be established by the Scripps
13Research Institute; providing that such rights are not
14exclusive; eliminating authority to assign such rights;
15prohibiting the use of eminent domain or other applicable
16law to acquire the property of another governmental entity
17in order to provide water and wastewater service to the
18biomedical research facility to be established by the
19Scripps Research Institute; providing an effective date.

21Be It Enacted by the Legislature of the State of Florida:
22
23     Section 1.  Section 4 of chapter 2003-420, Laws of Florida,
24is amended to read:
25     Section 4.  Notwithstanding any other provision of law, the
26county in which the projects that are part of or ancillary to
27the state-of-the-art biomedical research institution and campus
28to be established in this state by the grantee under section
29288.955, Florida Statutes, are to be located shall have the
30exclusive right, which right may be assigned in whole or in part
31by the governing body of the county in its sole discretion, to
32provide water and wastewater services to such projects to the
33extent deemed necessary by the governing body of the county. The
34county may plan, acquire, construct, reconstruct, enlarge or
35extend, operate, and maintain water and wastewater systems and
36facilities within or without the boundaries of such projects for
37the provision of water and wastewater services. Provided, the
38local government or utility service provider shall not be
39authorized to use the provisions of chapter 73 or chapter 74,
40Florida Statutes, or any other applicable law, to acquire by
41eminent domain the property of any other governmental entity in
42order to provide water and wastewater service to the biomedical
43research facility authorized pursuant to s. 288.955, Florida
44Statutes.
45     Section 2.  This act shall take effect upon becoming a law.
