  1                Senate Joint Resolution No. _____

  2         A joint resolution proposing the repeal of

  3         Section 25 of Article X of the State

  4         Constitution, relating to a patient's right to

  5         know about adverse medical incidents.

  7  Be It Resolved by the Legislature of the State of Florida:

  8  

  9         That the repeal of Section 25 of Article X of the State

10  Constitution is agreed to and shall be submitted to the

11  electors of this state for approval or rejection at the next

12  general election or at an earlier special election

13  specifically authorized by law for that purpose.

14         BE IT FURTHER RESOLVED that the following statement be

15  placed on the ballot:

16                     CONSTITUTIONAL AMENDMENT

17                      ARTICLE X, SECTION 25

18         PATIENTS' RIGHT TO KNOW ABOUT ADVERSE MEDICAL

19  INCIDENTS.--Proposing the repeal of Section 25 of Article X of

20  the State Constitution, which section prescribes a patient's

21  right of access to records relating to adverse medical

22  incidents which are made or received in the course of business

23  by a health care facility or provider.
