12 following amendment:

15 On page 3, lines 15 through 25, delete those lines
16
17 and insert:
18 Section 3. Subsections (2) and (4) of section
19 318.1451, Florida Statutes, are amended to read:
20 318.1451 Driver improvement schools.--
21 (2)(c) All approved courses of driver improvement
22 schools shall provide for a department approved final exam at
23 the conclusion of each course. Each and every student must
24 pass the final exam before the issuance of a completion
25 certificate. The final exam is required of all courses
26 including those utilizing technology as a delivery method.
27 Students failing the exam shall be allowed to re-exam once
28 without charge. Data indicating the number and scores of
29 students passing and/or failing the final exam required by
30 this paragragh shall be submitted to the department in a
31 format designated by the department.

1 (2)(d) In determining whether to approve an
2 intermediate driver improvement course required in s.
3 318.14(9), the department shall consider course content which,
4 at a minimum shall include a demonstration of driving ability
5 and ability to exercise ordinary and reasonable control in the
6 operation of a motor vehicle by the person attending the
7 course. For purposes of this paragraph, the intermediate
8 driver improvement course may include an actual driving skills
9 examination or a simulated driving skills examination.
10 (4) In addition to a regular course fee, an assessment
11 fee in the amount of $2.50 shall be collected by the school
12 from each person who elects to attend a course, as it relates
13 to ss. 318.14(9), 322.025(2), 322.0261, 322.291, and
14 627.06501, which shall be remitted to the Department of
15 Highway Safety and Motor Vehicles and deposited in the Highway
16 Safety Operating Trust Fund to administer this program and to
17 fund the general operations of the department.
