| 12 | Be It Enacted by the Legislature of the State of Florida: |
| 13 |
|
| 14 | Section 1. Section 215.5595, Florida Statutes, is created |
| 15 | to read: |
| 16 | 215.5595 Hurricane Recovery Trust Fund of 2005.-- |
| 17 | (1) There is created the Hurricane Recovery Trust Fund of |
| 18 | 2005 within the Department of Revenue. Funds shall be credited |
| 19 | to the trust fund as provided in s. 215.5593, the Hurricane |
| 20 | Recovery Assistance Program of 2005, to be used for the purposes |
| 21 | set forth therein. The trust fund is exempt from the service |
| 22 | charges imposed by s. 215.20. |
| 23 | (2) Notwithstanding the provisions of s. 216.301 and |
| 24 | pursuant to s. 216.351, any balance in the trust fund at the end |
| 25 | of any fiscal year shall remain in the trust fund at the end of |
| 26 | the year and shall be available for carrying out the purposes of |
| 27 | the trust fund. |
| 28 | (3) Pursuant to the provisions of s. 19(f)(2), Art. III of |
| 29 | the State Constitution, the trust fund shall, unless terminated |
| 30 | sooner, be terminated on the same day in the year 2009 as the |
| 31 | day of the effective date of this act. Prior to its scheduled |
| 32 | termination, the trust fund shall be reviewed as provided in s. |
| 33 | 215.3206. |
| 34 | Section 2. This act shall take effect upon becoming a law, |
| 35 | if House Bill 685 or similar legislation is adopted in the same |
| 36 | legislative session or an extension thereof and becomes law. |
