A bill to be entitled
2An act relating to special risk retirement; amending s.
3121.0515, F.S.; providing that emergency dispatchers and
4911 operators employed by a county or municipal law
5enforcement agency may participate as part of the Special
6Risk Administrative Support Class and are eligible for the
7special risk normal retirement date; providing an
8effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Paragraph (a) of subsection (7) of section
13121.0515, Florida Statutes, is amended to read:
14     121.0515  Special risk membership.--
15     (7)  RETENTION OF SPECIAL RISK NORMAL RETIREMENT DATE.--
16     (a)  A special risk member who is moved or reassigned to a
17nonspecial risk law enforcement, firefighting, correctional, or
18emergency medical care administrative support position with the
19same agency, or who is subsequently employed in such a position
20with any law enforcement, firefighting, correctional, or
21emergency medical care agency under the Florida Retirement
22System, shall participate in the Special Risk Administrative
23Support Class and shall earn credit for such service at the same
24percentage rate as that earned by a regular member.
25Notwithstanding the provisions of subsection (4), service in
26such an administrative support position shall, for purposes of
27s. 121.091, apply toward satisfaction of the special risk normal
28retirement date, as defined in s. 121.021(29)(b), provided that,
29while in such position, the member remains certified as a law
30enforcement officer, firefighter, correctional officer,
31emergency medical technician, or paramedic; remains subject to
32reassignment at any time to a position qualifying for special
33risk membership; and completes an aggregate of 6 or more years
34of service as a designated special risk member prior to
35retirement. Notwithstanding any other provision of law to the
36contrary, emergency dispatchers and 911 operators who are
37employed full time by a county or municipal law enforcement
38agency shall participate in the Special Risk Administrative
39Support Class. Such employees are eligible for the special risk
40normal retirement date, as defined in s. 121.021(29)(b), and
41shall earn credit for such service at the same percentage rate
42as that earned by a regular member.
43     Section 2.  This act shall take effect upon becoming a law.
