| 8 | sustenance or hydration as part of driver license or |
| 9 | identification card process.-- |
| 10 | (1)(a) The Department of Highway Safety and Motor Vehicles |
| 11 | shall develop and implement a program encouraging and allowing |
| 12 | persons as a part of the process of issuing identification cards |
| 13 | and issuing and renewing driver licenses to designate whether |
| 14 | they would wish to receive artificially provided sustenance or |
| 15 | hydration should they be in a persistent vegetative state. This |
| 16 | program shall include, after an individual has made such a |
| 17 | designation, making a notation on the front of the driver |
| 18 | license or identification card that clearly indicates the |
| 19 | individual's designation not to receive such artificially |
| 20 | provided sustenance or hydration and any other such methods as |
| 21 | the department may develop. |
| 22 | (b) Notwithstanding any other law, a notation on an |
| 23 | individual's driver license or identification card or in the |
| 24 | records of the Department of Highway Safety and Motor Vehicles |
| 25 | that an individual would not wish to receive artificially |
| 26 | provided sustenance or hydration should he or she be in a |
| 27 | persistent vegetative state is deemed sufficient to satisfy all |
| 28 | requirements for consent to withhold or withdraw such |
| 29 | artificially provided sustenance or hydration should the |
| 30 | individual be in a persistent vegetative state. |
| 31 | (c) The Department of Highway Safety and Motor Vehicles |
| 32 | shall incur no liability in connection with the performance of |
| 33 | any act authorized by this section. |
| 34 | (2) The Department of Highway Safety and Motor Vehicles |
| 35 | may adopt rules in accordance with ss. 120.536(1) and 120.54 to |
| 36 | carry out the provisions of this section. |
