| 7 | applies to the combined total of any judgment or |
| 8 | settlement paid, including any amount paid by further act |
| 9 | of the Legislature; providing an effective date. |

| 11 | Be It Enacted by the Legislature of the State of Florida: |
| 12 |

| 13 | Section 1. Subsection (8) of section 768.28, Florida |
| 14 | Statutes, is amended to read: |
| 15 | 768.28 Waiver of sovereign immunity in tort actions; |
| 16 | recovery limits; limitation on attorney fees; statute of |
| 17 | limitations; exclusions; indemnification; risk management |
| 18 | programs.-- |
| 19 | (8) The combined total for all fees charged, demanded, |
| 20 | received, or collected for all services rendered for a tort |
| 21 | claim under this section by an attorney, lobbyist, or any other |
| 22 | representative may not exceed No attorney may charge, demand, |
| 23 | receive, or collect, for services rendered, fees in excess of 25 |
| 24 | percent of the combined total of any judgment or settlement |
| 25 | paid, including any amount paid by further act of the |
| 26 | Legislature. |
| 27 | Section 2. This act shall take effect July 1, 2005. |
