A bill to be entitled
2An act relating to tort claims against the state; amending
3s. 768.28, F.S.; providing a limitation on fees charged,
4demanded, received, or collected for services rendered for
5a tort claim against the state by an attorney, lobbyist,
6or other representative; providing that such limitation
7applies to the combined total of any judgment or
8settlement paid, including any amount paid by further act
9of the Legislature; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Subsection (8) of section 768.28, Florida
14Statutes, is amended to read:
15     768.28  Waiver of sovereign immunity in tort actions;
16recovery limits; limitation on attorney fees; statute of
17limitations; exclusions; indemnification; risk management
18programs.--
19     (8)  The combined total for all fees charged, demanded,
20received, or collected for all services rendered for a tort
21claim under this section by an attorney, lobbyist, or any other
22representative may not exceed No attorney may charge, demand,
23receive, or collect, for services rendered, fees in excess of 25
24percent of the combined total of any judgment or settlement
25paid, including any amount paid by further act of the
26Legislature.
27     Section 2.  This act shall take effect July 1, 2005.
