  1                      A bill to be entitled

  2         An act relating to government contracting;

  3         amending s. 945.025, F.S.; providing that a

  4         revenue-generating contract entered into by the

  5         Department of Corrections in which a vendor

  6         uses governmental authority or property to sell

  7         goods or services is subject to the same

  8         procedures as the procurement of certain

  9         contractual services; providing an effective

10         date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Subsection (4) of section 945.025, Florida

15  Statutes, is amended to read:

16         945.025  Jurisdiction of department.--

17         (4)(a)  Nothing contained in chapter 287 shall be

18  construed as requiring competitive bids for health services

19  involving examination, diagnosis, or treatment.

20         (b)  A contract in which the department, in exchange

21  for revenue, authorizes a vendor to use governmental authority

22  or property for the purpose of selling any good or service to

23  any person shall be considered to be the procurement of a

24  contractual service in excess of the threshold amount for

25  CATEGORY FIVE and shall be awarded by competitive solicitation

26  in the same manner prescribed in part II of chapter 287.

27         Section 2.  This act shall take effect July 1, 2005.

 2                          SENATE SUMMARY

 3    Requires the Department of Corrections to treat a
      revenue-producing contract in which a vendor is
 4    authorized to use state authority or property to sell any
      good or service as the procurement of a contractual
 5    service in excess of $250,000 and to award the contract
      by competitive solicitation in the same manner as
 6    procurement of means of transport under part II of
      chapter 287, Florida Statutes.
