| 3 | 559.904, F.S.; requiring applicants for registration to |
| 4 | furnish proof of certain liability insurance; providing |
| 5 | that failure to maintain such insurance is grounds for |
| 6 | denial, revocation, or refusal to renew a registration; |
| 7 | providing an effective date. |

| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |
|
| 11 | Section 1. Subsection (10) of section 559.904, Florida |
| 12 | Statutes, is amended, and subsection (13) is added to that |
| 13 | section, to read: |
| 14 | 559.904 Motor vehicle repair shop registration; |
| 15 | application; exemption.-- |
| 16 | (10) The department may deny, revoke, or refuse to renew |
| 17 | the registration of a motor vehicle repair shop based upon a |
| 18 | determination that the motor vehicle repair shop, or any of its |
| 19 | directors, officers, owners, or general partners: |
| 20 | (a) Have failed to meet the requirements for registration |
| 21 | as provided in this part; |
| 22 | (b) Have not satisfied a civil fine, administrative fine, |
| 23 | or other penalty arising out of any administrative or |
| 24 | enforcement action brought by any governmental agency based upon |
| 25 | conduct involving fraud, dishonest dealing, or any violation of |
| 26 | this part; |
| 27 | (c) Have had against them any civil, criminal, or |
| 28 | administrative adjudication in any jurisdiction, based upon |
| 29 | conduct involving fraud, dishonest dealing, or any violation of |
| 30 | this part; or |
| 31 | (d) Have had a judgment entered against them in any action |
| 32 | brought by the department or the state attorney pursuant to ss. |
| 33 | 501.201-501.213 or this part; or. |
| 34 | (e) Have failed to maintain in force the insurance |
| 35 | required under subsection (13). |
| 36 | (13) Each initial or renewal applicant for registration |
| 37 | under this section must furnish the department with evidence |
| 38 | that the applicant has obtained liability insurance in the |
| 39 | amount of $1 million on repairs performed by the motor vehicle |
| 40 | repair shop. |
| 41 | Section 2. This act shall take effect July 1, 2005. |
