6 | An act relating to the Pine Tree Water Control District, |
7 | Palm Beach County; providing that the Pine Tree Water |
8 | Control District shall become a dependent district of the |
9 | Village of Wellington; providing that the Village of |
10 | Wellington Council members shall act as the board of |
11 | supervisors of said district; providing for a referendum; |
12 | providing an effective date. |

14 | WHEREAS, the property making up the Pine Tree Water Control |
15 | District was annexed into the Village of Wellington, and |
16 | WHEREAS, the Pine Tree Water Control District and the |
17 | Village of Wellington have entered into an operating agreement |
18 | where the district is staffed by Village of Wellington |
19 | employees, and |
20 | WHEREAS, the governing bodies of the Village of Wellington |
21 | and the Pine Tree Water Control District have mutually agreed |
22 | that the management of the offices of the district would be more |
23 | efficiently administered if the village council also acted as |
24 | the district board of supervisors, NOW, THEREFORE, |
25 |

26 | Be It Enacted by the Legislature of the State of Florida: |
27 |

28 | Section 1. Pine Tree Water Control District continuation |
29 | and transfer.--The Pine Tree Water Control District, an |
30 | independent special district created by a special act of the |
31 | Legislature, shall become a dependent district of the Village of |
32 | Wellington on the effective date of this act. All special acts |
33 | of the Pine Tree Water Control District shall become ordinances |
34 | of the Village of Wellington on the effective date of this act. |
35 | (1) The assets, liabilities, and written contracts of the |
36 | Pine Tree Water Control District, including all rights, |
37 | obligations, duties, and relationships now existing by law or |
38 | agreement shall be unaffected and shall remain in full force and |
39 | effect and shall be those of the district as a dependent |
40 | district of the Village of Wellington. All rights, claims, |
41 | actions, orders, and all contracts of the special district and |
42 | all legal or administrative proceedings involving the district |
43 | shall continue in full force and effect under the jurisdiction |
44 | of the district as a dependent district of the Village of |
45 | Wellington. |
46 | (2) The terms of office of the members of the Board of |
47 | Supervisors of the Pine Tree Water Control District shall |
48 | terminate, and the members of the Village Council of the Village |
49 | of Wellington shall assume the duties and responsibilities of |
50 | the Board of Supervisors of the Pine Tree Water Control |
51 | District. |
52 | (3) To the extent not inconsistent with village |
53 | ordinances, all resolutions and policies of the Pine Tree Water |
54 | Control District shall remain in effect until amended, revised, |
55 | or repealed by the village council. |
56 | (4) Additional provisions which are necessary to effect |
57 | this transition and to provide for the operation of the Pine |
58 | Tree Water Control District as a dependent district of the |
59 | village shall be adopted by ordinance. |
60 | Section 2. Referendum.--On or before December 1, 2006, the |
61 | Pine Tree Water Control District shall call and the Supervisor |
62 | of Elections of Palm Beach County shall conduct a referendum, in |
63 | accordance with the provisions of law relating to elections |
64 | currently in force, on the question of whether the Pine Tree |
65 | Water Control District shall become a dependent district of the |
66 | Village of Wellington. |
67 | Section 3. This act shall take effect only if a majority |
68 | of those qualified electors of the Pine Tree Water Control |
69 | District voting in a referendum held pursuant to this act |
70 | approve the referendum question in section 2, except that this |
71 | section and section 2 shall take effect upon becoming a law. |
