1	A bill to be entitled
2	An act relating to the Pine Tree Water Control District,
3	Palm Beach County; providing that the Pine Tree Water
4	Control District shall become a dependent district of the
5	Village of Wellington; providing that the Village of
6	Wellington Council members shall act as the board of
7	supervisors of said district; providing for a referendum;
8	providing an effective date.

10	WHEREAS, the property making up the Pine Tree Water Control
11	District was annexed into the Village of Wellington, and
12	WHEREAS, the Pine Tree Water Control District and the
13	Village of Wellington have entered into an operating agreement
14	where the district is staffed by Village of Wellington
15	employees, and
16	WHEREAS, the governing bodies of the Village of Wellington
17	and the Pine Tree Water Control District have mutually agreed
18	that the management of the offices of the district would be more
19	efficiently administered if the village council also acted as
20	the district board of supervisors, NOW, THEREFORE,
21
22	Be It Enacted by the Legislature of the State of Florida:
23
24	Section 1.  Pine Tree Water Control District continuation
25	and transfer.--The Pine Tree Water Control District, an
26	independent special district created by a special act of the
27	Legislature, shall become a dependent district of the Village of
28	Wellington on the effective date of this act. All special acts
29	of the Pine Tree Water Control District shall become ordinances
30	of the Village of Wellington on the effective date of this act.
31	(1)  The assets, liabilities, and written contracts of the
32	Pine Tree Water Control District, including all rights,
33	obligations, duties, and relationships now existing by law or
34	agreement shall be unaffected and shall remain in full force and
35	effect and shall be those of the district as a dependent
36	district of the Village of Wellington. All rights, claims,
37	actions, orders, and all contracts of the special district and
38	all legal or administrative proceedings involving the district
39	shall continue in full force and effect under the jurisdiction
40	of the district as a dependent district of the Village of
41	Wellington.
42	(2)  The terms of office of the members of the Board of
43	Supervisors of the Pine Tree Water Control District shall
44	terminate, and the members of the Village Council of the Village
45	of Wellington shall assume the duties and responsibilities of
46	the Board of Supervisors of the Pine Tree Water Control
47	District.
48	(3)  To the extent not inconsistent with village
49	ordinances, all resolutions and policies of the Pine Tree Water
50	Control District shall remain in effect until amended, revised,
51	or repealed by the village council.
52	(4)  Additional provisions which are necessary to effect
53	this transition and to provide for the operation of the Pine
54	Tree Water Control District as a dependent district of the
55	village shall be adopted by ordinance.
56	Section 2.  Referendum.--On or before December 1, 2006, the
57	Pine Tree Water Control District shall call and the Supervisor
58	of Elections of Palm Beach County shall conduct a referendum, in
59	accordance with the provisions of law relating to elections
60	currently in force, on the question of whether the Pine Tree
61	Water Control District shall become a dependent district of the
62	Village of Wellington.
63	Section 3.  This act shall take effect only if a majority
64	of those qualified electors of the Pine Tree Water Control
65	District voting in a referendum held pursuant to this act
66	approve the referendum question in section 2, except that this
67	section and section 2 shall take effect upon becoming a law.
