| 4 | Between lines 767 and 768, insert: |
| 5 | Section 18. Restoration activities for the Lake Okeechobee |
| 6 | Restoration Program managed by the Department of Environmental |
| 7 | Protection, the Department of Agriculture and Consumer Services, |
| 8 | the Fish and Wildlife Conservation Commission, or the South |
| 9 | Florida Water Management District are exempt from the |
| 10 | competitive procurement requirements established in s. 287.057, |
| 11 | Florida Statutes, but shall comply with the provisions of s. |
| 12 | 337.11, Florida Statutes, to the extent that the entities award |
| 13 | proposed construction, operations, and maintenance work to the |
| 14 | lowest responsible bidder or to the lowest evaluated responsible |
| 15 | bidder in a time-plus-money contract. The contract may provide |
| 16 | for an incentive payment to the contractor for early completion |
| 17 | of the project or critical phases of the work and for damages to |
| 18 | be assessed against the contractor for the completion of the |
| 19 | project or critical phases of the work in excess of the time |
| 20 | specified. Regardless of the option elected, the protest |
| 21 | procedures in s. 120.57(3), Florida Statutes, apply to all such |
| 22 | contracts. |
