11  Senator Fasano moved the following amendment:

13         Senate Amendment (with title amendment) 
14         Delete everything after the enacting clause
15  
16  and insert:  
17         Section 1.  Paragraph (b) of subsection (1) of section
18  796.07, Florida Statutes, is amended to read:
19         796.07  Prohibiting prostitution, etc.; evidence;
20  penalties; definitions.--
21         (1)  As used in this section:
22         (b)  "Lewdness" means any indecent or obscene act that
23  may cause substantial offense to one or more persons viewing
24  it or may otherwise substantially intrude upon the rights of
25  others. A lewd act may be offensive to, or may intrude upon
26  the rights of, a person who is a law enforcement officer.
27  Lewdness is to be determined based on what a reasonable member
28  of the public might find substantially offensive.
29         Section 2.  This act shall take effect July 1, 2005.

11         or assignation; providing an effective date.
