  1                      A bill to be entitled

  2         An act relating to the Criminal Justice

  3         Standards and Training Commission; amending s.

  4         943.11, F.S.; requiring that the members of the

  5         commission who are law enforcement officers and

  6         who are appointed by the Governor be chosen

  7         from a list of nominees submitted by a

  8         collective bargaining agent certified by the

  9         Public Employees Relations Commission;

10         providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Paragraphs (a) and (b) of subsection (1) of

15  section 943.11, Florida Statutes, are amended to read:

16         943.11  Criminal Justice Standards and Training

17  Commission; membership; meetings; compensation.--

18         (1)(a)  There is created a Criminal Justice Standards

19  and Training Commission within the Department of Law

20  Enforcement. The commission shall be composed of 19 members,

21  consisting of the Secretary of the Department of Corrections

22  or a designated assistant; the Attorney General or a designee;

23  the Director of the Division of the Florida Highway Patrol;

24  and 16 members appointed by the Governor, consisting of 3

25  sheriffs; 3 chiefs of police; 5 law enforcement officers who

26  are of the rank of sergeant or below within the employing

27  agency; 2 correctional officers, 1 of whom is an administrator

28  of a state correctional institution and 1 of whom is of the

29  rank of sergeant or below within the employing agency; 1

30  training center director; 1 person who is in charge of a

31  county correctional institution; and 1 resident of the state

 1  who falls into none of the foregoing classifications. Prior to

 2  the appointment, the sheriff, chief of police, law enforcement

 3  officer, and correctional officer members must shall have had

 4  at least 4 years' experience as law enforcement officers or

 5  correctional officers.

 6         (b)  The Governor, in making appointments under this

 7  section, shall take into consideration representation by

 8  geography, population, and other relevant factors in order

 9  that the representation on the commission be apportioned to

10  give representation to the state at large rather than to a

11  particular area.  In appointing the 5 law enforcement

12  officers, the Governor shall choose each appointment from a

13  list of 6 nominees. The list shall be submitted by the law

14  enforcement organization, inclusive of charters and chapters,

15  which the Public Employees Relations Commission certifies as

16  the collective bargaining agent for the largest number of

17  certified law enforcement bargaining units on the date the

18  list is submitted. The law enforcement organization shall

19  submit its list of 6 nominees at least 3 months before the

20  expiration of the term of any law enforcement officer member.

21  Of the appointed members, and except for correctional officers

22  of a state institution, there may be only one appointment from

23  any employing agency.

24         Section 2.  This act shall take effect upon becoming a

25  law.

 2                          SENATE SUMMARY

 3    Requires that the Governor appoint the members of the
      Criminal Justice Standards and Training Commission who
 4    are law enforcement officers from a list of nominees
      submitted by the collective bargaining agent that is
 5    certified by the Public Employees Relations Commission as
      representing the largest number of bargaining units for
 6    law enforcement officers.
