1 A bill to be entitled
2 An act relating to fire hydrants; amending s.
3 633.065, F.S.; requiring owners of fire
4 hydrants to test hydrants in accordance with
5 national standards; requiring nonfunctioning
6 privately owned hydrants to be reported and
7 repaired; providing fines for noncompliance;
8 providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Subsection (3) is added to section 633.065,
13 Florida Statutes, to read:
14 633.065 Requirements for installation, inspection, and
15 maintenance of fire suppression equipment.--
16 (3)(a) Each fire hydrant shall be tested in accordance
17 with National Fire Protection Standard 24, subsection 4-3.6,
18 and inspected and maintained in compliance with National Fire
19 Protection Association Standard 25, Standard for the
20 Inspection, Testing, and Maintenance of Water-Based Fire
21 Protection Systems, the edition currently adopted by the State
22 Fire Marshal pursuant to its code-adoption and
23 standards-adoption authority in this chapter. The owner of a
24 fire hydrant is responsible for performing the required
25 testing, inspecting, or maintenance of that fire hydrant.
26 (b) Inspection results that determine that a private
27 fire hydrant is nonfunctioning must be reported immediately to
28 the local authorities having jurisdiction.
29 (c) The owner of a private fire hydrant shall cause
30 any repair or replacement indicated by an inspection to be

1 made within 30 days and shall maintain records of the repair
2 or replacement.
3 (d) Consistent with s. 633.025(1), the requirements of
4 this subsection are deemed adopted by each municipality,
5 county, and special district that has responsibilities for
6 fire safety.
7 (e) Penalties for noncompliance with this subsection
8 shall be in accordance with s. 633.171.
9 Section 2. This act shall take effect July 1, 2005.

11 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
12 Senate Bill 748

14 The CS eliminates a provision in the bill requiring private
fire hydrant owners to have continuing maintenance contracts
15 for their hydrant(s).
16 The CS increases the penalties for violation fire hydrant
testing requirements in accordance with the existing
17 provisions of s. 633.171, F.S.
