  1                      A bill to be entitled

  2         An act relating to the exercise of eminent

  3         domain by municipalities; authorizing

  4         municipalities to exercise the power of eminent

  5         domain for public school purposes; providing

  6         for future expiration; providing an effective

  7         date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  A municipality may exercise the power of

12  eminent domain for the purpose of obtaining lands to be

13  conveyed by the municipality to the school board of the school

14  district within which the municipality is located if the

15  school board of that county requests in writing that the

16  municipality obtain such land for conveyance to the school

17  board and promises to use the land to establish a public

18  school thereon.  Fulfilling the purpose of this section is

19  recognized as constituting a valid municipal public purpose.

20  This section expires January 1, 2006.  Such expiration does

21  not affect an action in eminent domain which was filed before

22  January 1, 2006.

23         Section 2.  This act shall take effect upon becoming a

24  law.
