  1                      A bill to be entitled

  2         An act relating to the exercise of eminent

  3         domain by municipalities; authorizing specified

  4         municipalities to exercise the power of eminent

  5         domain for public school purposes; providing

  6         for future expiration; providing an effective

  7         date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  A municipality located within a county, as

12  defined in section 125.011(1), Florida Statutes, may exercise

13  the power of eminent domain for the purpose of obtaining lands

14  to be conveyed by the municipality to the school board of the

15  school district within which the municipality is located if

16  the school board of that county requests in writing that the

17  municipality obtain such land for conveyance to the school

18  board and promises to use the land to establish a public

19  school thereon.  Fulfilling the purpose of this section is

20  recognized as constituting a valid municipal public purpose.

21  This section expires January 1, 2007.  Such expiration does

22  not affect an action in eminent domain which was filed before

23  January 1, 2007.

24         Section 2.  This act shall take effect upon becoming a

25  law.

27          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
28                         Senate Bill 756

30  The CS limits the application of the provisions contained in
    the bill to Miami-Dade County. Additionally, the CS extends
31  the expiration date from January 1, 2006, to January 1, 2007.
