| 10 | scene of the crash; providing penalties; providing an |
| 11 | effective date. |

| 13 | Be It Enacted by the Legislature of the State of Florida: |
| 14 |
|
| 15 | Section 1. This act may be cited as the "Justin McWilliams |
| 16 | 'Justice For Justin' Act." |
| 17 | Section 2. Subsection (1) of section 316.027, Florida |
| 18 | Statutes, is amended to read: |
| 19 | 316.027 Crash involving death or personal injuries.-- |
| 20 | (1)(a) The driver of any vehicle involved in a crash |
| 21 | occurring on public or private property that results resulting |
| 22 | in injury of any person must immediately stop the vehicle at the |
| 23 | scene of the crash, or as close thereto as possible, and must |
| 24 | remain at the scene of the crash until he or she has fulfilled |
| 25 | the requirements of s. 316.062. Any person who willfully |
| 26 | violates this paragraph is guilty of a felony of the third |
| 27 | degree, punishable as provided in s. 775.082, s. 775.083, or s. |
| 28 | 775.084. |
| 29 | (b) The driver of any vehicle involved in a crash |
| 30 | occurring on public or private property that results resulting |
| 31 | in the death of any person must immediately stop the vehicle at |
| 32 | the scene of the crash, or as close thereto as possible, and |
| 33 | must remain at the scene of the crash until he or she has |
| 34 | fulfilled the requirements of s. 316.062. Any person who |
| 35 | willfully violates this paragraph is guilty of a felony of the |
| 36 | first second degree, punishable as provided in s. 775.082, s. |
| 37 | 775.083, or s. 775.084. |
| 38 | Section 3. This act shall take effect October 1, 2005. |
