7McWilliams 'Justice For Justin' Act"; amending s. 316.027,
8F.S.; revising provisions for a driver of a vehicle
9involved in a described crash to stop and remain at the
10scene of the crash; providing penalties; providing an
11effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  This act may be cited as the "Justin McWilliams
16'Justice For Justin' Act."
17     Section 2.  Subsection (1) of section 316.027, Florida
18Statutes, is amended to read:
19     316.027  Crash involving death or personal injuries.--
20     (1)(a)  The driver of any vehicle involved in a crash
21occurring on public or private property that results resulting
22in injury of any person must immediately stop the vehicle at the
23scene of the crash, or as close thereto as possible, and must
24remain at the scene of the crash until he or she has fulfilled
25the requirements of s. 316.062. Any person who willfully
26violates this paragraph is guilty of a felony of the third
27degree, punishable as provided in s. 775.082, s. 775.083, or s.
28775.084.
29     (b)  The driver of any vehicle involved in a crash
30occurring on public or private property that results resulting
31in the death of any person must immediately stop the vehicle at
32the scene of the crash, or as close thereto as possible, and
33must remain at the scene of the crash until he or she has
34fulfilled the requirements of s. 316.062. Any person who
35willfully violates this paragraph is guilty of a felony of the
36first second degree, punishable as provided in s. 775.082, s.
37775.083, or s. 775.084.
38     Section 3.  This act shall take effect October 1, 2005.
