A bill to be entitled
2An act relating to vehicle crashes; creating the "Justin
3McWilliams 'Justice For Justin' Act"; amending s. 316.027,
4F.S.; revising provisions for a driver of a vehicle
5involved in a described crash to stop and remain at the
6scene of the crash; providing penalties; providing an
7effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  This act may be cited as the "Justin McWilliams
12'Justice For Justin' Act."
13     Section 2.  Subsection (1) of section 316.027, Florida
14Statutes, is amended to read:
15     316.027  Crash involving death or personal injuries.--
16     (1)(a)  The driver of any vehicle involved in a crash
17occurring on public or private property that results resulting
18in injury of any person must immediately stop the vehicle at the
19scene of the crash, or as close thereto as possible, and must
20remain at the scene of the crash until he or she has fulfilled
21the requirements of s. 316.062. Any person who willfully
22violates this paragraph is guilty of a felony of the third
23degree, punishable as provided in s. 775.082, s. 775.083, or s.
24775.084.
25     (b)  The driver of any vehicle involved in a crash
26occurring on public or private property that results resulting
27in the death of any person must immediately stop the vehicle at
28the scene of the crash, or as close thereto as possible, and
29must remain at the scene of the crash until he or she has
30fulfilled the requirements of s. 316.062. Any person who
31willfully violates this paragraph is guilty of a felony of the
32first second degree, punishable as provided in s. 775.082, s.
33775.083, or s. 775.084.
34     Section 3.  This act shall take effect October 1, 2005.
