2 An act relating to state employment; amending
3 s. 110.219, F.S.; providing for a payout for
4 annual leave for certain state-employed law
5 enforcement officers, correctional officers,
6 and correctional probation officers; providing
7 an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (8) is added to section 110.219,
12 Florida Statutes, to read:
13 110.219 Attendance and leave; general policies.--
14 (8) Notwithstanding subsection (7) and any provision
15 to the contrary in s. 110.2037, each December a law
16 enforcement officer, correctional officer, or correctional
17 probation officer having at least 20 years of full-time
18 service with the state is entitled to a payout for up to 48
19 hours of annual leave, subject to the following conditions:
20 (a) The employee's annual leave balance after the
21 payout must be no less than 240 hours.
22 (b) The payout must be deposited in a tax-sheltered
23 plan under s. 401(a) of the Internal Revenue Code as provided
24 in s. 110.2037.

26 The payout provided for in this subsection is in addition to
27 any payout provided for in subsection (7).
28 Section 2. This act shall take effect July 1, 2005.

2 SENATE SUMMARY
3 Provides for a payout for up to 48 hours of annual leave
for state-employed law enforcement officers, correctional
4 officers, and correctional probation officers having at
least 20 years' full-time service. To be eligible, an
5 officer must have at least 240 hours of leave remaining
after the payout, which must be deposited into a
6 tax-sheltered plan.
