12  recommended the following amendment:

14         Senate Amendment (with title amendment) 
15         On page 2, between lines 3 and 4,
16  
17  insert:  
18         Section 2.  Section 563.09, Florida Statutes is created
19  to read:
20         563.09  Malt beverage tastings permitted;
21  limitations.--(1)  Notwithstanding any provision of law to the
22  contrary, a licensee may conduct malt beverage tastings upon
23  such licensed premises if the tastings are limited to and
24  directed toward the general public of legal drinking age.
25         (2)  This section does not apply to:
26         (a)  A licensee subject to an annual state license tax
27  under s. 563.02(1)(a) or s. 564.02(1)(a) operating a place of
28  business with less than 5000 square feet of floor space; or
29         (b)  A licensee subject to an annual state license tax
30  under s. 563.02(3).
31  and redesignate subsequent sections.
