| 2 | An act relating to the Sanford Airport Authority, Seminole |
| 3 | County; amending chapter 71-924, Laws of Florida; |
| 4 | authorizing the authority to enter into contracts, leases, |
| 5 | franchises, or other arrangements with any person or |
| 6 | persons granting the privilege of using or improving any |
| 7 | project of the authority, or any portion thereof of space |
| 8 | therein, for commercial purposes; providing requirements |
| 9 | and limitations with respect thereto; providing an |
| 10 | effective date. |

| 12 | Be It Enacted by the Legislature of the State of Florida: |
| 13 |
|
| 14 | Section 1. Subsection (4) of section 11 of chapter 71-924, |
| 15 | Laws of Florida, is amended to read: |
| 16 | Section 11. Powers.--The Sanford Airport Authority shall |
| 17 | have the following powers: |
| 18 | (4) To acquire property, real and personal, for the |
| 19 | purpose of establishing, constructing, enlarging, managing, and |
| 20 | operating airports, runways, navigational facilities, buildings, |
| 21 | structures, industrial parks, passenger terminals, fuel storage |
| 22 | facilities, roadways, taxiways, utility systems, and all other |
| 23 | facilities and improvements necessary or desirable for the |
| 24 | servicing of aircraft, the comfort and accommodation of air |
| 25 | travelers, and the operation of said airport facilities for both |
| 26 | foreign and domestic air transportation. |
| 27 | (a) The authority may acquire by the power of eminent |
| 28 | domain land and the improvements thereon only for public airport |
| 29 | purposes in the manner provided by chapters 73 and 74, Florida |
| 30 | Statutes, and other applicable laws. In addition to acquiring |
| 31 | land for airport purposes by eminent domain, the authority may |
| 32 | also acquire land and other property for airport purposes by |
| 33 | grant, donation, purchase, or lease in the manner otherwise |
| 34 | provided in this act for other projects. |
| 35 | (b) The authority may establish such rates, charges, and |
| 36 | user fees for use of airports and airport facilities as the |
| 37 | authority deems necessary. |
| 38 | (c) The authority may also construct or provide for the |
| 39 | construction of such special purpose facilities as are usually |
| 40 | provided for the repair and servicing of aircraft and for the |
| 41 | comfort and convenience of the public, including but not limited |
| 42 | to fueling equipment and storage, concessions, restaurants, food |
| 43 | and beverage facilities, hotels and other lodging facilities, |
| 44 | parking lots, and similar facilities. The authority may lease or |
| 45 | sell such special purpose facilities to provide operators or |
| 46 | concessionaires or such facilities may be operated by the |
| 47 | authority in its discretion. |
| 48 | (d) In the operation and management of the airports, the |
| 49 | authority may employ such managers, supervisors, technicians, |
| 50 | and other personnel as may be necessary for the economical and |
| 51 | efficient management thereof, and shall have the power to adopt |
| 52 | rules and regulations with reference to all projects and matters |
| 53 | under its control. All rules and regulations of the authority |
| 54 | shall be a matter of public record, and copies thereof shall be |
| 55 | dispensed by the authority at cost to all applicants therefor. |
| 56 | (e) In acquiring property from the City of Sanford or from |
| 57 | any public agency for airport purposes or in the operation of |
| 58 | any airport, the authority shall have full power to contract |
| 59 | with the Federal Aviation Authority or any federal agency |
| 60 | exercising any function with respect to aviation, air |
| 61 | navigation, or air transportation, and the authority shall have |
| 62 | full power to abide by all rules and regulations of such federal |
| 63 | agencies including the uses to which land may be put and the |
| 64 | operation of airports, air navigation facilities, and aircraft. |
| 65 | The authority shall further have power to assume any |
| 66 | obligations, covenants, or agreements heretofore imposed by any |
| 67 | governmental agency by deed, deed restriction or contract on the |
| 68 | City of Sanford, or any other governmental agency therein with |
| 69 | respect to airports or aviation. |
| 70 | (f) The authority in the acquisition, financing and |
| 71 | operation of airports and air navigation facilities may exercise |
| 72 | the authority and powers provided for cities, counties, |
| 73 | villages, or towns of Florida by chapter 332, Florida Statutes, |
| 74 | known as the Airport Law of 1945. |
| 75 | (g) The authority may advertise and publicize the use of |
| 76 | any airport operated by it and may expend its funds for such |
| 77 | purposes. |
| 78 | (h) The authority shall have full power to finance or |
| 79 | refinance the acquisition or construction of airport projects by |
| 80 | issuing its revenue bonds or other debt obligations in the |
| 81 | manner provided by chapter 332, Florida Statutes, known as the |
| 82 | Airport Law of 1945, or as provided by any other applicable |
| 83 | general law. |
| 84 | (i) The authority may enter into exclusive or nonexclusive |
| 85 | contracts, leases, franchises, or other arrangements with any |
| 86 | person or persons for terms not exceeding 50 years, granting the |
| 87 | privilege of using or improving any project of the authority, or |
| 88 | any portion thereof of space therein, for commercial purposes; |
| 89 | conferring the privilege of supplying goods, commodities, |
| 90 | things, and services or facilities at such project or projects; |
| 91 | making available services to be furnished by the authority or |
| 92 | its agents at such project; and establishing the terms and |
| 93 | conditions and fixing the charges, rentals, or fees for such |
| 94 | privileges or services so long as such fees or charges shall not |
| 95 | conflict with any applicable rules and regulations of the Public |
| 96 | Service Commission. |
| 97 | Section 2. This act shall take effect upon becoming a law. |
