A bill to be entitled
2An act relating to the Sanford Airport Authority, Seminole
3County; amending chapter 71-924, Laws of Florida;
4authorizing the authority to enter into contracts, leases,
5franchises, or other arrangements with any person or
6persons granting the privilege of using or improving any
7project of the authority, or any portion thereof of space
8therein, for commercial purposes; providing requirements
9and limitations with respect thereto; providing an
10effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Subsection (4) of section 11 of chapter 71-924,
15Laws of Florida, is amended to read:
16     Section 11.  Powers.--The Sanford Airport Authority shall
17have the following powers:
18     (4)  To acquire property, real and personal, for the
19purpose of establishing, constructing, enlarging, managing, and
20operating airports, runways, navigational facilities, buildings,
21structures, industrial parks, passenger terminals, fuel storage
22facilities, roadways, taxiways, utility systems, and all other
23facilities and improvements necessary or desirable for the
24servicing of aircraft, the comfort and accommodation of air
25travelers, and the operation of said airport facilities for both
26foreign and domestic air transportation.
27     (a)  The authority may acquire by the power of eminent
28domain land and the improvements thereon only for public airport
29purposes in the manner provided by chapters 73 and 74, Florida
30Statutes, and other applicable laws. In addition to acquiring
31land for airport purposes by eminent domain, the authority may
32also acquire land and other property for airport purposes by
33grant, donation, purchase, or lease in the manner otherwise
34provided in this act for other projects.
35     (b)  The authority may establish such rates, charges, and
36user fees for use of airports and airport facilities as the
37authority deems necessary.
38     (c)  The authority may also construct or provide for the
39construction of such special purpose facilities as are usually
40provided for the repair and servicing of aircraft and for the
41comfort and convenience of the public, including but not limited
42to fueling equipment and storage, concessions, restaurants, food
43and beverage facilities, hotels and other lodging facilities,
44parking lots, and similar facilities. The authority may lease or
45sell such special purpose facilities to provide operators or
46concessionaires or such facilities may be operated by the
47authority in its discretion.
48     (d)  In the operation and management of the airports, the
49authority may employ such managers, supervisors, technicians,
50and other personnel as may be necessary for the economical and
51efficient management thereof, and shall have the power to adopt
52rules and regulations with reference to all projects and matters
53under its control. All rules and regulations of the authority
54shall be a matter of public record, and copies thereof shall be
55dispensed by the authority at cost to all applicants therefor.
56     (e)  In acquiring property from the City of Sanford or from
57any public agency for airport purposes or in the operation of
58any airport, the authority shall have full power to contract
59with the Federal Aviation Authority or any federal agency
60exercising any function with respect to aviation, air
61navigation, or air transportation, and the authority shall have
62full power to abide by all rules and regulations of such federal
63agencies including the uses to which land may be put and the
64operation of airports, air navigation facilities, and aircraft.
65The authority shall further have power to assume any
66obligations, covenants, or agreements heretofore imposed by any
67governmental agency by deed, deed restriction or contract on the
68City of Sanford, or any other governmental agency therein with
69respect to airports or aviation.
70     (f)  The authority in the acquisition, financing and
71operation of airports and air navigation facilities may exercise
72the authority and powers provided for cities, counties,
73villages, or towns of Florida by chapter 332, Florida Statutes,
74known as the Airport Law of 1945.
75     (g)  The authority may advertise and publicize the use of
76any airport operated by it and may expend its funds for such
77purposes.
78     (h)  The authority shall have full power to finance or
79refinance the acquisition or construction of airport projects by
80issuing its revenue bonds or other debt obligations in the
81manner provided by chapter 332, Florida Statutes, known as the
82Airport Law of 1945, or as provided by any other applicable
83general law.
84     (i)  The authority may enter into exclusive or nonexclusive
85contracts, leases, franchises, or other arrangements with any
86person or persons for terms not exceeding 50 years, granting the
87privilege of using or improving any project of the authority, or
88any portion thereof of space therein, for commercial purposes;
89conferring the privilege of supplying goods, commodities,
90things, and services or facilities at such project or projects;
91making available services to be furnished by the authority or
92its agents at such project; and establishing the terms and
93conditions and fixing the charges, rentals, or fees for such
94privileges or services so long as such fees or charges shall not
95conflict with any applicable rules and regulations of the Public
96Service Commission.
97     Section 2.  This act shall take effect upon becoming a law.
