12 | Be It Enacted by the Legislature of the State of Florida: |

14 | Section 1. Section 288.833, Florida Statutes, is created |
15 | to read: |
16 | 288.833 State Homeland Security Trust Fund.-- |
17 | (1) There is created the State Homeland Security Trust |
18 | Fund, to be administered by the Division of Emergency Management |
19 | within the Department of Community Affairs. Funds shall be |
20 | credited to the trust fund as provided in s. 288.857(4)(c), to |
21 | be used to fund state homeland security with priorities for |
22 | funding to focus on costs not funded by the Federal Government, |
23 | such as operational costs of security at seaports and other |
24 | venues. Requests for funding shall be reviewed by the Domestic |
25 | Security Oversight Board which shall provide recommended funding |
26 | priorities. |
27 | (2) Notwithstanding the provisions of s. 216.301 and |
28 | pursuant to s. 216.351, any balance in the trust fund at the end |
29 | of any fiscal year shall remain in the trust fund at the end of |
30 | the year and shall be available for carrying out the purposes of |
31 | the trust fund. |
32 | (3) In accordance with s. 19(f)(2), Art. III of the State |
33 | Constitution, the State Homeland Security Trust Fund shall be |
34 | terminated on July 1, 2009, unless terminated sooner. Before its |
35 | scheduled termination, the trust fund shall be reviewed as |
36 | provided in s. 215.3206(1) and (2). |
37 | Section 2. This act shall take effect July 1, 2005, if |
38 | House Bill 605 or similar legislation creating the Travel To and |
39 | Commerce With Terrorist Nations Act is adopted in the same |
40 | legislative session or an extension thereof and becomes law. |
