A bill to be entitled
2An act relating to interstate highway safety; creating the
3interstate highway traffic safety priority program area in
4the Department of Transportation Highway Safety Grant
5Program; providing requirements for awarding grants;
6amending s. 318.18, F.S.; providing for a surcharge for
7disposition of traffic infractions; amending s. 318.21,
8F.S.; providing for distribution of the surcharge;
9providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Interstate highway safety grants.--An
14interstate highway traffic safety priority program area is added
15to the Department of Transportation Highway Safety Grant
16Program. Grants awarded under this priority program area shall
17be available to any law enforcement agency with jurisdiction to
18enforce traffic laws on an interstate highway. Grants under this
19program area shall be awarded using the same procedures and
20criteria used for other program areas, as applicable, except
21that grants under this program area must be used for interstate
22highway traffic safety to assist in addressing traffic safety
23deficiencies, expand an ongoing activity, or develop a new
24program related to interstate highway traffic safety.
25     Section 2.  Subsection (14) is added to section 318.18,
26Florida Statutes, to read:
27     318.18  Amount of civil penalties.--The penalties required
28for a noncriminal disposition pursuant to s. 318.14 are as
29follows:
30     (14)  In addition to any penalties imposed for noncriminal
31traffic infractions pursuant to this chapter, a $20 surcharge
32shall be paid for each infraction and shall be distributed as
33provided under s. 318.21(13).
34     Section 3.  Subsection (13) is added to section 318.21,
35Florida Statutes, to read:
36     318.21  Disposition of civil penalties by county
37courts.--All civil penalties received by a county court pursuant
38to the provisions of this chapter shall be distributed and paid
39monthly as follows:
40     (13)  The additional surcharge on traffic infractions
41provided for under s. 318.18(14) shall be collected and remitted
42by the clerk of the court to the Department of Revenue to be
43distributed as follows:
44     (a)  Ten dollars of each surcharge collected shall be
45distributed to the Department of Transportation Highway Safety
46Grant Program to enhance funds available for grant awards under
47the interstate highway traffic safety priority program area.
48     (b)  Ten dollars of each surcharge collected shall be
49deposited into the General Revenue Fund to be used to improve
50highway safety and enhance traffic law enforcement on interstate
51highways.
52     Section 4.  This act shall take effect July 1, 2005.
