| 10 | Escambia Counties; providing for removal of code |
| 11 | provisions that allow certain buildings to be designed for |
| 12 | internal pressures; directing the Florida Building |
| 13 | Commission to consider various issues in the code- |
| 14 | development process; amending s. 553.71, F.S.; deleting |
| 15 | the definition of the term "exposure category C" for |
| 16 | purposes of the code; directing the Florida Building |
| 17 | Commission to consider addressing exposure category C |
| 18 | areas in the Florida Building Code; defining the term |
| 19 | "exposure category C"; providing an effective date. |

| 21 | Be It Enacted by the Legislature of the State of Florida: |
| 22 |
|
| 23 | Section 1. Subsection (3) of section 109 of chapter 2000- |
| 24 | 141, Laws of Florida, is amended to read: |
| 25 | Section 109. The Legislature has reviewed the Florida |
| 26 | Building Code that was adopted by action of the Florida Building |
| 27 | Commission on February 15, 2000, and that was noticed for rule |
| 28 | adoption by reference in Rule 9B-3.047, F.A.C., on February 18, |
| 29 | 2000, in the Florida Administrative Weekly on page 731. The |
| 30 | Florida Building Commission is directed to continue the process |
| 31 | to adopt the code, pursuant to section 120.54(3), Florida |
| 32 | Statutes, and to incorporate the following provisions or |
| 33 | standards for the State of Florida: |
| 34 | (3) For areas of the state not within the high velocity |
| 35 | hurricane zone, the commission shall adopt, pursuant to s. |
| 36 | 553.73, Florida Statutes, the wind protection requirements of |
| 37 | the American Society of Civil Engineers, Standard 7, 2002 1998 |
| 38 | edition as implemented by the International Building Code, 2003 |
| 39 | 2000 edition. The commission shall consider, through the code- |
| 40 | development process, any updates to Standard 7 which the society |
| 41 | may adopt, and as modified by the commission in its February 15, |
| 42 | 2000, adoption of the Florida Building Code for rule adoption by |
| 43 | reference in Rule 9B-3.047, Florida Administrative Code. The |
| 44 | commission shall consider the issue of windborne-debris |
| 45 | requirements applicable to land beyond 1 mile of the coast |
| 46 | However, from the eastern border of Franklin County to the |
| 47 | Florida-Alabama line through the code-development process, only |
| 48 | land within 1 mile of the coast shall be subject to the |
| 49 | windborne-debris requirements adopted by the commission. The |
| 50 | exact location of wind speed lines shall be established by local |
| 51 | ordinance, using recognized physical landmarks such as major |
| 52 | roads, canals, rivers, and lake shores, wherever possible. |
| 53 | Buildings constructed in the windborne debris region must be |
| 54 | either designed for internal pressures that may result inside a |
| 55 | building when a window or door is broken or a hole is created in |
| 56 | its walls or roof by large debris, or be designed with protected |
| 57 | openings. The commission shall consider the issue of Except in |
| 58 | the high velocity hurricane zone, local governments may not |
| 59 | prohibit the option of designing buildings to resist internal |
| 60 | pressures through the code-development process. |
| 61 | Section 2. Subsections (10) and (11) of section 553.71, |
| 62 | Florida Statutes, are amended to read: |
| 63 | 553.71 Definitions.--As used in this part, the term: |
| 64 | (10) "Exposure category C" means, except in the high |
| 65 | velocity hurricane zone, that area which lies within 1,500 feet |
| 66 | of the coastal construction control line, or within 1,500 feet |
| 67 | of the mean high tide line, whichever is less. On barrier |
| 68 | islands, exposure category C shall be applicable in the coastal |
| 69 | building zone set forth in s. 161.55(5). |
| 70 | (10)(11) "Prototype building" means a building constructed |
| 71 | in accordance with architectural or engineering plans intended |
| 72 | for replication on various sites and which will be updated to |
| 73 | comply with the Florida Building Code and applicable laws |
| 74 | relating to firesafety, health and sanitation, casualty safety, |
| 75 | and requirements for persons with disabilities which are in |
| 76 | effect at the time a construction contract is to be awarded. |
| 77 | Section 3. The Florida Building Commission shall consider |
| 78 | how to address exposure category C in the building code. As used |
| 79 | in this section, the term "exposure category C" means, except in |
| 80 | the high velocity hurricane zone, that area which lies within |
| 81 | 1,500 feet of the coastal construction control line, or within |
| 82 | 1,500 feet of the mean high tide line, whichever is less. On |
| 83 | barrier islands, exposure category C is applicable in the |
| 84 | coastal building zone set forth in section 161.55(5), Florida |
| 85 | Statutes. |
| 86 | Section 4. This act shall take effect July 1, 2005. |
