A bill to be entitled
2An act relating to wind-protection provisions of the
3Florida Building Code; amending ch. 2000-141, Laws of
4Florida; providing for removal of outdated wind-protection
5standards from the Florida Building Code; providing for an
6update of the code's wind-protection standards;
7eliminating the exemption from windborne-debris
8requirements currently applicable in certain areas of
9Franklin, Gulf, Bay, Walton, Okaloosa, Santa Rosa, and
10Escambia Counties; providing for removal of code
11provisions that allow certain buildings to be designed for
12internal pressures; directing the Florida Building
13Commission to consider various issues in the code-
14development process; amending s. 553.71, F.S.; deleting
15the definition of the term "exposure category C" for
16purposes of the code; directing the Florida Building
17Commission to consider addressing exposure category C
18areas in the Florida Building Code; defining the term
19"exposure category C"; providing an effective date.

21Be It Enacted by the Legislature of the State of Florida:
22
23     Section 1.  Subsection (3) of section 109 of chapter 2000-
24141, Laws of Florida, is amended to read:
25     Section 109.  The Legislature has reviewed the Florida
26Building Code that was adopted by action of the Florida Building
27Commission on February 15, 2000, and that was noticed for rule
28adoption by reference in Rule 9B-3.047, F.A.C., on February 18,
292000, in the Florida Administrative Weekly on page 731. The
30Florida Building Commission is directed to continue the process
31to adopt the code, pursuant to section 120.54(3), Florida
32Statutes, and to incorporate the following provisions or
33standards for the State of Florida:
34     (3)  For areas of the state not within the high velocity
35hurricane zone, the commission shall adopt, pursuant to s.
36553.73, Florida Statutes, the wind protection requirements of
37the American Society of Civil Engineers, Standard 7, 2002 1998
38edition as implemented by the International Building Code, 2003
392000 edition. The commission shall consider, through the code-
40development process, any updates to Standard 7 which the society
41may adopt, and as modified by the commission in its February 15,
422000, adoption of the Florida Building Code for rule adoption by
43reference in Rule 9B-3.047, Florida Administrative Code. The
44commission shall consider the issue of windborne-debris
45requirements applicable to land beyond 1 mile of the coast
46However, from the eastern border of Franklin County to the
47Florida-Alabama line through the code-development process, only
48land within 1 mile of the coast shall be subject to the
49windborne-debris requirements adopted by the commission. The
50exact location of wind speed lines shall be established by local
51ordinance, using recognized physical landmarks such as major
52roads, canals, rivers, and lake shores, wherever possible.
53Buildings constructed in the windborne debris region must be
54either designed for internal pressures that may result inside a
55building when a window or door is broken or a hole is created in
56its walls or roof by large debris, or be designed with protected
57openings. The commission shall consider the issue of Except in
58the high velocity hurricane zone, local governments may not
59prohibit the option of designing buildings to resist internal
60pressures through the code-development process.
61     Section 2.  Subsections (10) and (11) of section 553.71,
62Florida Statutes, are amended to read:
63     553.71  Definitions.--As used in this part, the term:
64     (10)  "Exposure category C" means, except in the high
65velocity hurricane zone, that area which lies within 1,500 feet
66of the coastal construction control line, or within 1,500 feet
67of the mean high tide line, whichever is less.  On barrier
68islands, exposure category C shall be applicable in the coastal
69building zone set forth in s. 161.55(5).
70     (10)(11)  "Prototype building" means a building constructed
71in accordance with architectural or engineering plans intended
72for replication on various sites and which will be updated to
73comply with the Florida Building Code and applicable laws
74relating to firesafety, health and sanitation, casualty safety,
75and requirements for persons with disabilities which are in
76effect at the time a construction contract is to be awarded.
77     Section 3.  The Florida Building Commission shall consider
78how to address exposure category C in the building code. As used
79in this section, the term "exposure category C" means, except in
80the high velocity hurricane zone, that area which lies within
811,500 feet of the coastal construction control line, or within
821,500 feet of the mean high tide line, whichever is less. On
83barrier islands, exposure category C is applicable in the
84coastal building zone set forth in section 161.55(5), Florida
85Statutes.
86     Section 4.  This act shall take effect July 1, 2005.
