13         Senate Amendment (with title amendment) 
14         On page 80, between lines 11 and 12,
15  
16  insert:  
17         Section 13.  Notwithstanding any provision to the
18  contrary in Committee Substitute for Committee Substitute for
19  Senate Bill 404, enacted in the 2005 Regular Session of the
20  Legislature, the Agency for Health Care Administration is
21  required to comply with chapter 120, Florida Statutes, when
22  setting Medicaid rates and methods of payments, and the
23  substance of Medicaid rates is subject to judicial review.
24  Sections 8, 10, and 23 of Committee Substitute for Committee
25  Substitute for Senate Bill 404 do not apply retroactively to
26  contracts, fees, rates, and other methods of payment in
27  existence before the effective date of Committee Substitute
28  for Committee Substitute for Senate Bill 404, and any fee or
29  rate schedule approved through the rate-setting process
30  existing as of July 1, 2004, shall be incorporated into the
31  provider agreement or any agreement relating to Medicaid goods
