12 following amendment:

14 Senate Amendment (with title amendment)
15 On page 79, between lines 11 and 12,

17 insert:
18 Section 14. The Office of Program and Policy Analysis
19 and Government Accountability, in consultation with the Office
20 of Attorney General, Medicaid Fraud Control Unit and the
21 Auditor General, shall conduct a study to examine issues
22 related to the amount of state and federal dollars lost due to
23 fraud and abuse in the Medicaid prescription drug program. The
24 study shall focus on examining whether pharmaceutical
25 manufacturers and their affiliates and wholesale
26 pharmaceutical manufacturers and their affiliates that
27 participate in the Medicaid program in this state, with
28 respect to rebates for prescription drugs, are inflating the
29 average wholesale price that is used in determining how much
30 the state pays for prescription drugs for Medicaid recipients.
31 The study shall also focus on examining whether the

1 manufacturers and their affiliates are committing other
2 deceptive pricing practices with regard to federal and state
3 rebates for prescription drugs in the Medicaid program in this
4 state. The study, including findings and recommendations,
5 shall be submitted to the Governor, the President of the
6 Senate, the Speaker of the House of Representatives, the
7 Minority Leader of the Senate, and the Minority Leader of the
8 House of Representatives by January 1, 2006.
