17  and insert:  
18         (50)  To the extent permitted by federal law and as
19  allowed under s. 409.906, the agency shall provide
20  reimbursement for emergency mental health care services for
21  Medicaid recipients in crisis-stabilization facilities
22  licensed under s. 394.875 as long as those services are less
23  expensive than the same services provided in a hospital
24  setting.
25         Section 2.  Section 409.91211, Florida Statutes, is
26  created to read:
27         409.91211  Medicaid managed care pilot program.--
28         (1)  The agency is authorized to seek experimental,
29  pilot, or demonstration project waivers, pursuant to s. 1115
30  of the Social Security Act, to create a more efficient and
31  effective service delivery system that enhances quality of

One 3 demonstration site shall include only Broward County. A second 4 demonstration site shall initially include Duval County and 5 shall be expanded to include Baker, Clay, and Nassau Counties 6 within 1 year after the Duval County program becomes 7 operational. This waiver authority is contingent upon federal 8 approval to preserve the upper-payment-limit funding mechanism 9 for hospitals, including a guarantee of a reasonable growth 10 factor, a methodology to allow the use of a portion of these 11 funds to serve as a risk pool for demonstration sites, 12 provisions to preserve the state's ability to use 13 intergovernmental transfers, and provisions to protect the 14 disproportionate share program authorized pursuant to this 15 chapter. 16 17 18 ================ T I T L E A M E N D M E N T =============== 19 And the title is amended as follows: 20 On page 2, line 23, through 21 page 3, line 6, delete those lines 22 23 and insert: 24 program could be expanded; authorizing the 25 agency to pay for emergency mental health 26 services provided through licensed 27 crisis-stabilization facilities; creating s. 28 409.91211, F.S.; specifying waiver authority 29 for the Agency for Health Care Administration 30 to establish a Medicaid reform program 31 contingent on federal approval to preserve the 2 12:26 PM 05/02/05 s0838c2c-02-j22
