20  404 are repealed.
21         Section 14.  The amendments made to section 409.907,
22  Florida Statutes, by the Conference Committee Report on
23  Committee Substitute for Committee Substitute for Senate Bill
24  404 are repealed.
25         Section 15.  The amendments made to the introductory
26  provision only of section 409.908, Florida Statutes, by the
27  Conference Committee Report on Committee Substitute for
28  Committee Substitute for Senate Bill 404 are repealed.
29         Section 16.  Section 409.9082, Florida Statutes, as
30  created by the Conference Committee Report on Committee
31  Substitute for Committee Substitute for Senate Bill 404, is

Section 23 of the Conference Committee 3 Report on Committee Substitute for Committee Substitute for 4 Senate Bill 404 is repealed. 5 Section 18. Subsection (2) of section 409.9124, F.S., 6 as amended by section 18 of the Conference Committee Report on 7 Committee Substitute for Committee Substitute for Senate Bill 8 404 is amended, and subsection (6) is added to that section, 9 to read: 10 409.9124 Managed care reimbursement.-- 11 (2) Each year prior to establishing new managed care 12 rates, the agency shall review all prior year adjustments for 13 changes in trend, and shall reduce or eliminate those 14 adjustments which are not reasonable and which reflect 15 policies or programs which are not in effect. In addition, the 16 agency shall apply only those policy reductions applicable to 17 the fiscal year for which the rates are being set, which can 18 be accurately estimated and verified by an independent 19 actuary, and which have been implemented prior to or will be 20 implemented during the fiscal year. The agency shall pay rates 21 at per-member, per-month averages that equal, but do not 22 exceed, the amounts allowed for in the General Appropriations 23 Act applicable to the fiscal year for which the rates will be 24 in effect. 25 (6) For the 2005-2006 fiscal year only, the agency 26 shall make an additional adjustment in calculating the 27 capitation payments to prepaid health plans, excluding prepaid 28 mental health plans. This adjustment must result in an 29 increase of 2.8 percent in the average per-member, per-month 30 rate paid to prepaid health plans, excluding prepaid mental 31 health plans, which are funded from Specific Appropriations 2 1:06 PM 05/05/05 s0838e1c-02-j34

The Senate Select Committee on Medicaid 3 Reform shall study how provider rates are established and 4 modified, how provider agreements and administrative 5 rulemaking effect those rates, the discretion allowed by 6 federal law for the setting of rates by the state, and the 7 impact of litigation on provider rates.
