11  The Committee on Ways and Means (Campbell) recommended the
12  following amendment:

14         Senate Amendment (with title amendment) 
15         On page 17, between lines 21 and 22,
16  
17  insert:  
18         (d)  In the two areas selected by the agency and
19  department to begin implementation of the integrated system,
20  the agency shall adopt rules providing for minimum staffing
21  requirements for nursing homes, which include, for each
22  nursing home facility, a minimum certified nursing assistant
23  staffing of 2.9 hours of direct care per resident per day,
24  effective December 1, 2005. No facility shall staff below one
25  certified nursing assistant per 20 residents, and a minimum
26  licensed nursing staffing of 1.0 hour of direct resident care
27  per resident per day but not below one licensed nurse per 40
28  residents. Nursing assistants employed under s. 400.211(2) may
29  be included in computing the staffing ratio for certified
30  nursing assistants only if they provide nursing assistance
31  services on a full-time basis. Each nursing home must document

The agency shall 4 recognize the use of licensed nurses for compliance with 5 minimum staffing requirements for certified nursing assistants 6 if the facility otherwise meets the minimum staffing 7 requirements for licensed nurses and the licensed nurses are 8 performing the duties of certified nursing assistants. Unless 9 otherwise approved by the agency, licensed nurses counted 10 toward the minimum staffing requirements for certified nursing 11 assistants must exclusively perform the duties of certified 12 nursing assistants for the entire shift and not also be 13 counted toward the minimum staffing requirements for licensed 14 nurses. If the agency has approved the facility's request to 15 use a licensed nurse to perform licensed nursing and certified 16 nursing assistant duties, the facility must allocate the 17 amount of staff time specifically spent on certified nursing 18 assistant duties for the purpose of documenting compliance 19 with minimum staffing requirements for certified and licensed 20 nursing staff.
