14 On page 79, between lines 11 and 12,

16 insert:
17 Section 14. The Office of Program and Policy Analysis
18 and Government Accountability, in consultation with the Office
19 of Attorney General, Medicaid Fraud Control Unit and the
20 Auditor General, shall conduct a study to examine issues
21 related to the amount of state and federal dollars lost due to
22 fraud and abuse in the Medicaid prescription drug program. The
23 study shall focus on examining whether pharmaceutical
24 manufacturers and their affiliates, that participate in the
25 Medicaid program in this state, with respect to rebates for
26 prescription drugs, are inflating the average wholesale price
27 that is used in determining how much the state pays for
28 prescription drugs for Medicaid recipients. The study shall
29 also focus on examining whether the manufacturers and their
30 affiliates are committing other deceptive pricing practices
31 with regard to federal and state rebates for prescription

1 drugs in the Medicaid program in this state. The study,
2 including findings and recommendations, shall be submitted to
3 the Governor, the President of the Senate, the Speaker of the
4 House of Representatives, the Minority Leader of the Senate,
5 and the Minority Leader of the House of Representatives by
6 January 1, 2006.
