11  The Committee on Transportation (Clary) recommended the
12  following amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 2, lines 6-10, delete those lines
16  
17  and insert:  
18         (13)  Each applicant for an initial or renewal
19  registration under this section shall provide the department
20  with evidence of current and valid liability insurance in an
21  amount not less than $300,000 on repairs performed by the
22  motor vehicle repair shop. The department shall require that
23  an applicant present a certificate of insurance issued by an
24  insurance company or carrier authorized to transact business
25  in this state before an initial or renewal registration
26  certificate may be issued to the applicant.
27         Section 2.  Paragraph (b) of subsection (4) of section
28  559.921, Florida Statutes, is amended, and subsection (9) is
29  added to that section, to read:

Issuing a notice of noncompliance pursuant to s. 5 120.695. 6 2. Imposing an administrative fine not to exceed 7 $1,000 per violation for each act which constitutes a 8 violation of this part or a rule or order. 9 3. Imposing an administrative fine not to exceed 10 $5,000 per violation for failure to maintain the liability 11 insurance required under s. 559.904(13). 12 4.3. Directing that the motor vehicle repair shop 13 cease and desist specified activities. 14 5.4. Refusing to register or revoking or suspending a 15 registration. 16 6.5. Placing the registrant on probation for a period 17 of time, subject to such conditions as the department may 18 specify. 19 (9) A person who engages in motor vehicle repair and 20 fails to maintain current and valid liability insurance as 21 required under s. 559.904(13) commits a misdemeanor of the 22 second degree, punishable as provided in s. 775.082 or s. 23 775.083. 24 25 (Redesignate subsequent sections.) 26 27 28 ================ T I T L E A M E N D M E N T =============== 29 And the title is amended as follows: 30 On page 1, line 7, after the semicolon, 31 2 2:02 PM 02/21/05 s0864c-tr04-j02
